인터넷의 발달과 저작물 창작 및 유통수단의 변화 그리고 이러한 변화들을 야기하는정보의 디지털화 현상으로 인해 세계 각국에서는 저작권제도 개혁이 새로운 화두로 등장하고 있다. 디지털 기술 발전을 통해 새로운 유형의 저작물 제공 서비스가 등장하고 있다. 새로운 기술과 서비스의 등장과 저작물 이용환경이 급변함에 따라 기존 법체계와의 정합성에 문제가 노출되고 있고, 새로운 유형의 서비스 등장에 따른 저작자-이용자간분쟁 지속, 인공지능 창작 등 기술변화에 따른 저작권법 적용 문제 등 현행 저작권법체계의 한계가 노출되고 있다. ’57년 저작권법 제정 이후 ’86년⋅’06년 두 차례 전부개정이 있었지만, 새로운 디지털 기술 발전에 따라 급변하는 저작권 환경과 저작권법 사이의 간극을 회복하고, 빅데이터와 인공지능⋅AR(증강현실)⋅블록체인과 , 메타버스 서비스 등 새로운 저작권 쟁점의 대응방안을 모색할 필요가 있다. 본 글은 최근 저작물 이용 서비스로 주목을 받고 있는 가상⋅증강현실 서비스, NFT 아트, 그리고 온라인 실시간 콘서트에서 나타나고 있는 저작권법 과제를 분석하고, 디지털 기술 발전에 따른 저작권 보호 및 제한 체계 패러다임의 변화에 적절히 대응하기위하여 필요한 우리 저작권 정책 및 제도 개선 사항에 관한 이슈를 분석하고자 한다.
Due to the development of the Internet, changes in the means of creation and distribution of works, and the digitization of information that causes these changes, Copyright Regime Reform is emerging as a new topic in countries around the world. Through the development of digital technology, a new type of service provision of copyrighted works is emerging. With the advent of new technologies and services and the rapid change in the environment for using works, the problem of compatibility with the existing legal system is being exposed. The limitations of the current copyright law system such as problems are exposed. Therefore, after the enactment of the Copyright Act in 1957, there were two revisions in 1986 and 2006, but with the development of new digital technology, the gap between the rapidly changing copyright environment and the law was restored, and big data, artificial intelligence, AR (augmented reality). It is necessary to review the entire copyright law system to respond to new copyright issues such as blockchain, NFT (Non-Fungible Token), and metaverse services. This article analyzes the copyright law issues that are appearing in virtual/augmented reality services, NFT art, and online real-time concerts, which are attracting attention as a service for using copyrighted works, and responds appropriately to changes in the paradigm of copyright protection and restriction system according to the development of digital technology. This aricle intends to analyze the issues related to the improvement of our copyright policy and system.
