2020년 텔레그램 ‘n번방’ 사건이 여성과 아동에 대한 성착취 범죄로 크게 문제가 되면서, 정보통신기술발달과 함께 확대･진화하고 있는 디지털 성범죄에 대한 입법정책적인 대응이 마련되었다. 2020년 국회에서는 관련법을 개정하여, 디지털 성범죄물에 대해 ‘성착취’라는 새로운 개념을 법률에 도입하고, 성착취물의 제작, 배포 등 공급자에 대한 처벌에서 소지, 접근, 시청의 수요행위까지 처벌하는 등 그 규제대상과 범위를 확대하였다. 또한 전기통신사업자에게디지털 성범죄물의 유통방지 의무와 모니터링의 책무를 부과하면서 디지털 성범죄물 유통방지를 위한 실효성도 강화하였다. 아동･청소년 그루밍 죄를 신설하고 위장수사제도를 도입하여아동･청소년 대상 디지털 성착취 범죄의 범위를 확대하고 사전단계에까지 개입하여 처벌할 수있도록 하였다. 하지만, 이러한 조치들은 그동안 사적인 문제로 취급되었던 카메라 촬영물과음란물(淫亂物)에 대해 디지털 성범죄물이란 인식의 전환과 이를 규제하고 처벌하기 위한 기초적인 대책이 마련되었을 뿐이다. 이후 디지털 성범죄를 근절하고 대책의 실효성을 확보하기위해서는 다양한 제도가 보완되어야 한다. 구체적 개선방안으로 아동청소년 디지털 성착취 전담 긴급 대응체계 마련, 디지털 성범죄 대응 응급조치 신설, 디지털성범죄피해자지원과 감시･ 신고･삭제지원 체계의 체계화 및 강화, 디지털 성착취 수익 독립몰수제도, 역외사업자에 대한규정 등의 도입을 제안하였다. 아울러 지난 20년간 확대･진화하였던 디지털 성착취 산업, 온라인, SNS 등을 이용한 성산업, 성매매 산업 등에 대한 포괄적인 정책적 개입이 필요하며, 이것이 이 연구의 후속 과제이다.
The case of ‘Telegram n Chatting Room’ was a major problem as a sexual exploitation crime against women and children in Korea. Along with the development of information and communication technology, a strong legislative policy response to digital sex crimes that are expanding and evolving has been prepared. First, a new concept of digital sexual exploitation was introduced into the law, and its target and scope were expanded, including punishing suppliers for production and distribution of sexual exploitation, as well as punishing possession, access, and viewing. Second, by imposing obligations such as monitoring and distribution of digital sex crimes on telecommunications operators, the effectiveness of digital sex crimes distribution prevention was also strengthened. However, these measures have only provided a basic measure to regulate and punish perceptions of digital sexual crimes that have remained in private cameras and child pornography. Afterwards, in order to eradicate digital sex crimes and secure the effectiveness of countermeasures, the provision of an online grooming regulation system for children and adolescents, support for victims of digital sex crimes, and institutionalization of surveillance and reporting systems should be additionally introduced.
