최근들어 금융범죄, 성범죄, 의료범죄, 사기, 교통사고 범죄, 실종 사건 등이 증가하고 있음에도 인력이 부족한 경찰에서는 사건처리에 필요한 수사 및 증거확보 업무처리를 충분히 하지 못하고 있다. 이에 따라 억울한 사건을 해결하기 위해 심부름센터, 탐정, 행정사 등에게 현장조사, 증거자료수집 등 업무처리를 위탁하고 있는 실정이다. 음성적으로 흥신소에 요청하여 사실조사 및 증거자료를 의뢰함에 따른 부작용 피해가 발생해도 보상을 받지 못하고 있는 실정이다. 탐정은 사건 수요자로부터 의뢰내용을 받고 적법한 업무범위 내에서 필요한 자료, 증거수집, 사실조사를 하여 관련내용을 의뢰인에게 제공하는 서비스 활동이다. 탐정제도를 법적·제도적으로 정식 도입하여 건전하게 탐정을 육성하여 사생활침해 및 불법피해가 발생하지 않도록 해야 한다. 탐정제도를 도입하고자 1999년도부터 논의되어 왔으나 도입에 대한 법적근거 마련, 법무부와 경찰 간의 주관기관 논쟁 등으로 도입을 하지 못하고 있다. OECD 국가에서는 우리나라를 제외하고 이미 탐정제도를 광범위하게 도입 운영하고 있다. 우리나라는 향후 탐정제도 도입을 위해서는 법적근거 마련, 감독 및 주관기관 설정, 탐정협회의 역할 등에 대해 명확하게 업무분장 범위가 결정되어야 한다. 또한 탐정협회 설립을 통해서 탐정업 종사자 교육, 탐정관련 학술연구, 공제사업 등이 이루어져야 할 것이다. 따라서 본 연구에서는 외국 탐정제도 분석, 우리나라 탐정제도 도입에 따른 문제점을 파악 및 개선방안 마련, 주관기관, 탐정협회 설립 등 업무역활을 제시하고자 한다.

A detective is a service activity that receives the contents of the request from the consumer of the case, collects necessary data, evidence, and investigates facts within the legitimate scope of work, and provides the relevant contents to the client. The detective system should be formally introduced legally and institutionally to foster detectives soundly so that privacy violations and illegal damage do not occur. It has been discussed since 1999 to introduce the detective system, but it has not been introduced due to legal grounds for its introduction and disputes between the Ministry of Justice and the police. OECD countries have already introduced and operated a wide range of detective systems except for Korea. In order to introduce the detective system in the future in Korea, the scope of division of work should be clearly determined on the establishment of legal grounds, establishment of supervisory and supervisory agencies, and the role of the detective association. In addition, through the establishment of the Detective Association, education for detective workers, academic research related to detectives, and deduction projects should be carried out. Therefore, this study aims to present business roles such as analyzing the foreign detective system, identifying and preparing improvement measures for the introduction of the Korean detective system, and establishing a supervising agency and detective association.
