2000년에 도쿄에서 열린 ‘일본군성노예전범여성국제법정’은 1966년의 러셀법정에서 시작된 ‘민(民)들의 법정’의 계보를 잇는 것으로 이해되어 왔다. 그러나 베트남전쟁에서 미국의 전쟁범죄를 물었던 러셀법정은 그 효력과 권위의 토대를 ‘민’의 층위에 두는 민들의 법정의 시초였음에도, 전시성폭력을 비롯한 여성에 대한 폭력, 그리고 에코사이드라 불리는 생태학살을 범죄로 다루지 않았다는 점에서 커다란 한계를 내포하고 있었다. 이는 다름 아닌 ‘민’이라는 범주가 가진 한계이기도 하다. 따라서 이 글에서는 ‘새로운 민’의 가능성, 즉 국가가 셈하는 국민/시민 혹은 인간-존재만을 지칭하는 개념어에 국한되지 않는, 확장된 개념으로서 ‘민’을 사용하고자 한다. 러셀법정에서 가시화되지 못했던 전시성폭력 뿐만 아니라, 일상에서 여성들에게 자행되는 폭력까지 범죄로 다루었던 민들의 법정은 1976년 브뤼셀에서 개최되었다. 이는 적극적인 페미니스트들에 의해 조직된 최초의 ‘여성에 대한 범죄 국제법정’이었음에도 한국에서는 다뤄진 바 없다. 이 법정에서는 일본군 ‘위안부’의 존재와 기생관광의 실태, 그리고 재일조선인 유학생 간첩단 조작사건의 성고문 피해까지 보고되었다. 에코사이드에 대한 민들의 법정은 2016년에 ‘몬산토 국제법정’이라는 이름으로 헤이그에서 열렸다. 그러나 이 법정에서는 ‘생태’가 무엇을 말하는지에 대한 논의가 생략되어 있으며, 여전히 인간을 지배의 정점에 둔 피라미드형 ‘생태계’로 상상되어온 세계를 한발자국도 넘어서지 못한 ‘위계’ 속에 머물러 있고, 베트남 전쟁과 관련된 법정의 판단은 최초의 민들의 법정인 러셀법정보다 오히려 후퇴한 것으로 보인다.
‘Women’s International War Crimes Tribunal on the Trial of Japan’s Military Sexual Slavery’ is held in Tokyo in 2000, to be linking the genealogy of civilian trials Russell’s 1966 that began in court. This is the aggressive feminist organized by following the original ‘An international court crimes against women’, not be treated as such in South Korea.
