2･28 정신과 전태일 정신은 오늘날 어떠한 내용으로 재조명될 수 있는가? 본 논문은 이러한 물음에 대해 2･28과 전태일의 서사를 통해서 도출 가능한 ‘쉴 권리’가 하나의 유의미한 답변이 될 수 있다고 본다. 역사 정신을 매개로 하여 쉴 권리의 고유한 가치를 모색하는 작업은쉴 권리에 둔감한 우리사회에 중요한 시사와 전언을 줄 수 있을 것이다. 본문에서는 ‘2･28민주운동 결의문’과 ‘전태일 수기’ 분석을 통해 2･28 정신과 전태일 정신 모두가 쉴 권리에 대한 역사적인 준거로 기능할 수 있다는 점을 검토하고, 쉴 권리에 둔감한 우리 사회의 구조와맥락을 탐사하는 차원에서 입법･행정･사법 권력과 연동된 정당강령과 사법판결 또한 비판적으로 검토해본다. 지금-우리가 마주하고 있는 공동체의 위기는 여러 가지 측면에서 언급될 수있겠지만, 특히나 비극적인 것은 노동현장에서 각종의 산업재해와 노동자의 사망이 마치 일상이 된 것처럼 전개되고 있다는 점이다. 여기에 2･28 정신과 전태일 정신은 쉴 권리의 실질적보장을 위한 우리시대의 기획인 휴식권의 헌법규정화, 연결차단권의 설계, 기본소득제의 도입과 같은 정책적 설계에 강력한 역사적 정당성을 부여해 줄 수 있다고 본다. 그리고 이것은 오늘의 문명시대를 지속하기 위한 지성의 발현으로도 볼 수 있을 것이다.
How can the spirit of 2･28 democratic movement and Jeon Taeil’s spirit be re-examined on today? This paper believes that the ‘right to rest’ that can be derived from the narrative of 2･28 and Jeon Taeil can be one answer to this question. The work of seeking the inherent value of the right to rest through the spirit of history can give important implications to our society, which is insensitive to the right to rest. This article reviews the fact that both the 2･28 and Jeon Taeil’s spirit can function as historical references for the right to rest through the analysis of the 2･28 Democratic Movement Resolution and the Jeon Taeil’s memorandum. In addition, in order to explore the structure and context of our society, which is insensitive to the right to rest, I will also critically review the party platform and judicial decisions linked to the legislative, administrative, and judicial powers. The community crisis we are facing now can be dealt with in many ways, but what is particularly tragic is that various industrial accidents and worker deaths are unfolding as if they had become a daily routine. In this situation, I think that the 2･28 spirit and Jeon Taeil’s spirit can give strong historical justification to the constitutional regulation of the right to rest, the design of the right to disconnect, and introduction of the basic income system for the practical guarantee of the right to rest. And this can be seen as an expression of intelligence to continue today’s civilized age.
