경찰의 도주차량 추격은 「경찰관직무집행법」상의 직무인 범죄의 진압, 공공의 안녕과질서 유지를 위해 불가피하지만 그 위험성으로 인하여 적극적인 도주차량 추격이 쉽지않은 현실이다. 지난 2019년 경찰청은 「112 신고 접수·지령 매뉴얼」을 통해 도주차량을 경찰순찰차로 직접 충격하여 상황을 종결시키는 ‘직접차단’ 방법을 도입, 시행에 들어갔다. 경찰권은 필요최소한의 범위 내에서 극히 제한적으로 행사되어야 하는 것은 물론 반드시국회가 제정한 법률이나 법률의 구체적 위임에 의한 법규명령에 경찰권 행사의 근거가 마련되어 있어야 하는 법률유보원칙이 엄격히적용된다. 이 연구의 분석 결과 도주차량의 후면 또는 후측면을 경찰순찰차로 충격하는 경우 도주차량이 균형을잃고 전복되거나 2차사고로 이어져 무고한 시민의 안전까지도 위협할 수 있어 「경찰관직무집행법」 및 「위해성경찰장비의 사용기준 등에 관한 규정」상의 위해성 경찰장비 특히, 무기로 규정하는 것이 법리상 타당하다. 현재 경찰청 내부지침에 불과한 「112 신고 접수·지령 매뉴얼」만으로 규정된 직접차단은 헌법상 법률유보원칙에 위배되어 위헌소지가 있다. 따라서 경찰의 도주차 량 직접차단 관련 제반 법규정의 조속한 정비를 통해 직접차단에 활용되는 경찰순찰차의위해성 경찰장비 지정, 관련 안전교육 및 안전검사 기준 정립, 직접차단에 활용된 경찰순찰차의 유지·보수, 직접차단의 보다 구체적인실행 방법 및 주의사항 등을 규정하고, 도주차량 직접차단 교육·훈련·평가 프로그램 신설및 교육·훈련환경 구축, 도주차량 추격용GPS 위치추적기 등 비침해적 추격방안도 모색되어야 할 것이다.
Police high-speed chase, a significant part of police duties, may result in serious property damage, personal injury, and death to make police pursuit too hazardous to undertake as frequently as the present policy permits. Recently, the Korean National Police Agency(KNPA) has adopted precision intervention technique as an official policy that allows its officers to force a fleeing vehicle to lose control and stop during police high-speed pursuit situations. The Constitution of Korea mandates any governmental attempts to limit citizens’ constitutional rights to have their basis on the legislation enacted by the National Assembly. Nevertheless, the current police pursuit policy of the KNPA is apparently ill-advised, in fact, unconstitutional, as the policy is only approved by the internal policy of the KNPA even though police precision-intervention technique maneuvers may endanger citizens. In this regard, the present study analyzed the constitutionality of the new police high-speed pursuit policy within the context of Article 37 of the Korean Constitution.
