장애인차별금지법이 제정․시행된 지 10여 년이 지났으나 우리 사회에는 여전히 장애인차별에 대한 인식이 높지 않고, 이로 인해 매년 1,00여 건의 차별행위 관련 진정이 인권위원회에 제기되고 있다. 법 제정 이후에도 큰 진전이 없는 주요한 이유로 장애인차별금지법의 내재적 한계를 지적하고 있으며, 이를 보완하기 위해 장애 및 차별행위의 개념, 구제조치의 실효성 부족, 소극적 손해배상제도 및 소송지원제도 미비 등의 내용을 개정할 것이요구되고 있다. 한편, 최근 장애를 포함하여 우리 사회의 모든 차별 요소들을 포괄하는 차별금지법안이발의되었고, 동 법안에서는 그동안 장애인차별금지법에서 미진했었던 부분을 보완할 수 있는 진일보한 내용들을 포함하고 있다. 차별금지법안에 대한 우리 사회의 공감대가 아직은충분히 형성되어 있지 않기 때문에 동 법안의 국회통과를 낙관하기는 어렵다. 하지만, 법안의 통과 여부와는 관계없이 차별행위금지 및 피해자구제조치 방안 등 선진화된 법안의 내용은 장애인차별금지법 개정시 우선 반영을 검토할 수 있을 것이다. 이를 통해 장애인들을다양한 차별행위로부터 보호하고 피해구제의 실효성을 높임으로써 장애인의 인권향상에기여할 수 있도록 해야 할 것이다.
More than a decade has pased since the ‘Act on the Prohibiton of Discriminationagainst Person with Disabilties(Prohibiton of Discrimination Act)’ was enacted andenforced, but there is stil a low awarenes of discrimination in our society, and morethan 1,00 cases of discrimination are filed with the Human Rights Commision everyyear. As such, it points out the inherent limitations of the Prohibiton of DiscriminationAct as a major reason for not making much progres even after the enactment of theAct. To compensate for this, it is required to revise the concepts of disabilty anddiscrimination, lack of efectivenes of relief measures, pasive damage compensationsystem and insuficient litgation suport system. Meanwhile, the Anti-Discrimination Bil has recently ben proposed that covers al thediscriminative elements of our society, including disabilties, and it containsadvancements that can compensate for the shortcomings in the Prohibiton ofDiscrimination Act. It is not easy for the bil to be pased by the National Asembly,as our society does not have enough consensus on the Anti-Discrimination Act. However,the developments contained in the Bil, including measures to remedy victims, shouldbe actively reflected in the revision of the Prohibiton of Discrimination Act rather thandiscarded. This wil increase the efectivenes of the Prohibiton of Discrimination Actand protect the disabled from various discriminatory acts, thereby improving humanrights of the disabled.
