최근 기후변화대응과 탄소중립에 대한 각국의 정책변화와 법제정비가 이루어지고 있다. 우리나라도 그린뉴딜에 따라 기후변화대응과 탄소중립에 대한 법제적 변화가 일어나고 있으며, 저탄소녹색성장기 본법, 지속가능발전법, 에너지법을 중심으로 하고 있다. 이와 관련한 제⋅개정 법안들은 저탄소녹색성 장기본법의 보완 또는 대체 그리고 지속가능발전법의 기본법화를 다루고 있다. 저탄소녹색성장기본법은 기후변화적응에 대한 규정을 보완할 필요가 있으며, 지방자치단체의 역할 강화, 정책조율기능의 강화, 시민참여기제의 확보, 기후영향평가의 실효성 확보, 정의로운 전환의 기반 마련도 과제이다. 저탄소녹색성장기본법과 지속가능발전법과의 관계는 여전히 문제로 남아있다. 최근의 기후변화대응법안들과 이들을 통합하여 환노위원장 대안으로 본회의를 통과한 기후위기 대 응을 위한 탄소중립·녹색성장 기본법은 기후변화대응과 탄소중립사회로의 전환을 위한 전략, 계획과 수단을 담고 있다. 그러나 여전히 정책조율기구에 대한 규정은 두고 있지 않으며, 기후영향평가의 실 효성 확보, 시민참여의 법적기반 강화, 지방자치단체의 역할 명확화는 여전히 개선되어야 할 과제이 다. 아울러 지속가능발전법과의 관계도 여전히 논의가 필요한 부분이다.
In recent years, policy changes and legislative revisions are being made in each country regarding climate change response and carbon neutrality(Net-Zero). In Korea, legal changes are taking place in response to climate change and carbon neutrality centering on the Green New Deal. Legislative changes are taking place centered on the Framework Act on Low Carbon, Green Growth, the Sustainable Development Act, and the Energy Act. The enacted and amended bills in this regard deal with supplementation or replacement of the Framework Act on Low Carbon, Green Growth and restoration of the status of the Sustainable Development Act as a basic law. The Framework Act on Low Carbon, Green Growth needs to supplement provisions on adaptation to climate change, strengthening the role of local governments, strengthening the policy coordination function, securing a mechanism for citizen participation, securing the effectiveness of climate impact assessment, and laying the foundation for a just transition is also a challenge. The relationship between the Framework Act on Low Carbon, Green Growth and the Sustainable Development Act still remains a problem. The recent reform bill on Climate Change Response Act contains strategies, plans and means for responding to climate change and transitioning to a carbon-neutral society. However, there are still no provisions on the policy coordination body, and the task of securing the effectiveness of climate impact assessment, preparing a legal basis for citizen participation, and clarifying the role of local governments still needs to be improved. The reform bill on Climate Change Response Act and the reform bill on Framework Act on Sustainable Development are areas that require an integrated legislative discussion
