법과 정치의 관계에 대한 자유주의와 공화주의의 양분된 지점에서, 우리는 칼 슈미트의 헌법학과 만난다. 그의 헌법학은 자유주의적 입헌주의가 보여주는 선험적인 도덕적 계율에 근거한 것이 아니라 정치와의 연계 속에서 헌법을 이해한다. 그의 헌법개념은 헌법이 설립됨으로써 정치적 통일체가 정립되는 것이 아니라, 헌법이 설립되기 이전에 정치적 통일체의 실재에 기초해 있다. 이런 점에서 그가 말하는 헌법은 헌법 스스로 제정된다는 것은 합당하지 못한 표현이다. 그의 헌법은 헌법을 제정하는 자들의 실제적인 정치적 의사에 의해서 만들어진다. 다시 말해서 헌법제정권력자가 정치적 통일체 전체의 특수한 존재형식에 대해서 내린 결단의 산물이 그가 말하는 헌법이다. 이런 점에서 칼 슈미트의 헌법학은 일견 법과 정치를 연계시키는 공화주의와 유사한 면을 보여주고 있다. 하지만 공화주의가 통약가능성을 전제로 한 정치적 낙관주의에 기초해 있다면, 칼 슈미트의 헌법학은 통약불가능성을 전제로 한 정치적 현실주의에 기초해 있다. 칼 슈미트는 정치적 현실이 보여주는 다양한 윤리적인 삶의 방식들 간의 힘의 불균등성과 적대를 ‘정치적인 것’의 개념으로 형상화한다. 그의 ‘정치적인 것’의 개념은 공공선이나 인류애와 같은 순수한 혹은 낭만적인 동기들에 의해서 추동되는 것이 아니라 ‘적과 동지’라는 이분법적인 대립구도의 틀에서 기술된다. 적과의 적대적 대립적 관계 속에서 형성되는 정치적 통일체는 적과의 죽고 죽이는 전쟁의 결과물이다. 이것이 정치의 본질이다. 칼 슈미트의 이러한 정치에 대한 관점은 우리에게 다소 폭력적으로 이해될 수 있지만, 우리의 역사나 현실은 이를 잘 반영해 주고 있다. 우리의 정치적 현실에 대한 깊이 있는 고찰은 우리로 하여금 여러 정치세력들 간의 합의나 조화보다는 이들들 간에 보여주는 전쟁과 갈등이 우리 정치의 일상화임을 깨닫게 한다.
In the divided place between liberalism and republicanism on the relationship of politics and law, we meet K. Schmitt’s constitution. His constitution is based not on moral priority, but on the politics. In other words His constitution is founded on the political unity. In this point the idea that constitution itself is founded is not reasonable. His constitution is formed by the political judgement of sovereign. His constitution is the outcome of Sovereign’s judgement for the special being of political unity. In this point, his constitution is similar with republicanism which connects law with politics. But while republicanism is based on political optimism on commensurability, he is based on political realism on incommensurability. K. Schmitt forms the inequivalency of power and antagonism among diverse ethic life-forms which political reality shows as ‘the political’. His ‘political’ is formed not on pure or romantic motivations such as common-good and humanity, but on the dichotomy such as enemy and friend. The political unity formed in the hostile confrontment with enemy is the outcome of the war between enemy and friend. This is the essence of politics. Though this political position of K. Schmittis understanded as the violent, our history and reality have showed this. The deep investigation for our political reality gets us to realize that the war and conflict among political powers is the more daily than the consensus and harmony among them.
