문재인정부가 추진한 자치분권정책을 되돌아보고 자치분권정책추진의 접근방식과 가치들 그리고 특징들을 검토하는 것은 의미 있는 일일 것이다. 문재인정부 자치분권의 주요 내용은 2018년 9월 11일 발표한 「자치분권종합계획」에 담겨있다. 자치분권종합계획의 내용들은 지방자치법 전부개정과 지방이양일괄법 그리고 자치경찰법 등에 반영되어 입법화되었다. 자치분권적 문제해결의 3대 핵심주제는 다양성과 공동체 그리고 주민주권이다. 다양성은 선택적 자유 확장을 위한 제도개선으로, 공동체의 지향은 협력적 제도개선으로, 주민주권은 주민권리로서의 참여권 보장과 확장으로 입법에 반영되었다. 첫째, 다양성의 반영은 대도시제도에 더하여 특별시제도 도입, 특별지방자치제도 도입, 그리고 자치단체 구성 형태(기관구성의 다양화)의 다양화 등으로 입법화되었다. 둘째, 공동체의 지향은 기관 간의 관계 형성을 상호 배타적이 아닌 책임이 동반된 협력적 관계자로의 입법화되었다. 즉, 자치분권 사전협의제, 국정 통합성을 위한 협력의무 부과, 중앙-지방협력회의 설치 등이 대표적이다. 마지막으로 주민주권의 구현은 주민자치의 원리를 지방자치법의 목적규정에 명시하고, 주민의 참정권을 주민생활에 영향을 미치는 정책결정과 집행과정으로 확대하여 입법화되었다. 참정권의 요건을 완화하는 등 주민주권의 구현을 제도적 권한으로 확립한 것은 민주적 가치의 제도화에 중요한 변환점이라고 평가된다.
It would be a meaningful work to review the decentralization policy promoted in President Moon’s government and the approaches, values and characteristics of it. The major contents of Moon government’s decentralization policy are included in the Decentralization Master Plan announced in September 11, 2018. For the sustainable development of society in the future, the three main subjects reflected the Master Plan were diversity, community, and citizen’s sovereignty. The idea of approach to these subjects is to enrich democratic competition of political system. Especially, to improve the competition between central government and local government and between citizens and representatives is focused. Diversity was reflected in legislation as expansion of the liberty of citizen’s selection, community as cooperative system improvement, and citizen’s sovereignty as securing and expanding participation rights in local policy process. First, the reflection of diversity was legislated as introduction of special cities, special local governments, and diversification of local government structure. Second, orientation for community was legislated as forming the relationship between central and local organizations not as mutually exclusive but as cooperative-namely, establishment of central and local cooprative meetings, prearrangement system in decentralization policy, and imposition of accompanying responsibility for national integration, etc. Lastly, realization of citizen’s sovereignty was legislated in Local Autonomy Act as specifying the principles of citizen’s autonomy and expanding the political rights of citizens to the local policy decisions and execution processes that affect resident life. It is considered a turning point in institutionalizing the democratic values to have established expansion and improvement of citizen’s liberty in decentralization policy.
