최근 어선 출입항 환경이 과거에 비교하여 크게 변화되었고, 기술발전에 의한 어선식별이 가능해짐에 따라 어민들의 불편을 해소하기 위해 규제완화의 필요성이 있다. 본 논문의 연구방법은 현행 법ㆍ제도를 분석하는 것으로 어선출ㆍ입항 제도의 특성과 선행연구의 검토, 현황분석을 통하여 문제점을 도출하여 개선방안을 제시하였다. 개선방안은 다음과 같다. 첫째, 스마트폰으로 출입항 신고를 할 수 있도록 어선 출입항 신고시스템을 구축하고, 스마트폰이나 인터넷으로 출입항 신고를 할 수 있도록 제도를 변경해야 한다. 둘째, 수산업 종사자들의 편의를 위해 간소화하고, 어선 안전조업의 일원화라는 관점에서 대행신고소에 관리를 어선안전조업본부에서 일원적으로 관리하는 것이 행정비용을 축소하는 효과적인 방법이다. 셋째, 출입항 신고제도의 개선은 경찰기관이 아닌 수산행정기관이 일원적으로 담당하고, 궁극적으로는 어민의 조업 자유와 편익을 보장하기 위해서 어선출입항 제도를 폐지하는 방향으로 개편되어야 할 것이다. 급격한 규제완화는 혼란을 야기할 수 있으므로 단계적ㆍ점진적으로 시행되는 것이 바람직하다. 남북한의 군사적 대치상황이라는 특수한 상황을 고려하여 특정해역과 일반해역의 규제방안을 차별적으로 설정하였다. 본 연구가 갖는 함의는 1970년대 이후 지속되어 왔던 어선 출ㆍ입항제도의 간소화 방안을 제시했다는 점에서 의미가 있다. 본 연구의 한계로는 특수한 남북관계 때문에 현행 제도를 급격하게 개선한다기 보다는 점진적 방법으로 개선할 것을 제안하였다. 그로 인하여 어민들의 조업 자유가 다소 침해될 수 있다는 점이다.
Recently, the environment of fisherboat’s incoming and outgoing has changed significantly compared to the past, and as fisher boats can be identified by technology development, there is a need for deregulation to solve the inconvenience of fishermen. Accordingly, the following improvements were suggested. First, a new fishing vessel entry and exit reporting system that can report the entry and exit ports on a mobile phone should be established to simplify the entry and exit reporting on a mobile phone or the Internet. Second, it is considered that it is an efficient method to simplify the convenience of the fisheries workers and to manage the management in the agency report center in a unified manner in the fishing boat safety operation headquarters. Third, the improvement of the system of entry-exit reporting system should be made in the direction of unification of the fisheries administration, not the police agency, and ultimately in the direction of abolition to guarantee the freedom and convenience of the people. Rapid deregulation can cause confusion, so it is desirable to be implemented step by step. Considering the specificity of military confrontation, the deregulation plan of specific and general seas was set differently.
