북한이탈주민이 남한사회에 안정적으로 정착하고 대한민국 국민으로서 정체성을 가지기 위해서는 삶의 모든 영역에서 이들에 대한 적절한 수준의 보호와 지원이 필요하고, 이는 헌법이 우리 정치공동체의 유지와 발전을 위해 제대로 규범력을 발휘하기 위한 전제조건이기도 하다. 헌법 제3조에 근거하여 북한주민은 그 상황이나 장소에 관계없이 모두 대한민국 국민으로서 법적 지위를 보유하고, 북한이탈주민에 대한 지원과 보호의 문제는 애초부터 단절 없이 대한민국 국민인 북한이탈주민과 대한민국 간의 기본권 관계로서 헌법문제이다. 「북한이탈주민의 보호 및 정착지원에 관한 법률」에 대한 해석과 운용의 출발점은 북한주민이 대한민국 국민으로서 헌법상 기본권 보장의 의미와 취지가 그대로 실현되어야 할 기본권의 주체로서 인식하는 가운데, 그들이 남한사회에 진정으로 통합될 수 있는 삶의 조건과 환경을 마련하는 것에 있다. 탈북의료인의 대한민국의 의료자격 인정과 관련한 절차에 대해서는 상반되는 평가가 존재한다. 국민의 생명과 건강을 보호하는 의료행위의 특수성에 비추어 의료자격의 인정과 관련한 평가의 차이는 충분히 수긍할 만하다. 그러나 북한이탈주민이 남한사회에 안정적으로 정착하고 국민으로서 정체성을 확립하기 위하여 위 법률에서 정하는 국가적 차원의 보호와 지원 역시 국민의 생명과 건강에 대한 보호와 같은 헌법적 가치와 지위를 가지는 것이다. 독일이 분단상황에서부터 통일과정, 그리고 통일독일을 완성하기까지 서독과 동독의 정치체제, 사회경제체제, 교육제도 등의 차이에도 불구하고, 그 차이점보다는 공통점을 강조함으로써 동독주민을 적극적으로 수용한 것은 우리에게 시사하는 바가 크다고 생각한다.
In order for North Korean defectors to settle stably in South Korean society and have an identity as a South Korean citizen, appropriate levels of protection and support are needed in all areas of life, which is a prerequisite for the constitution to exercise its normative power for the maintenance and development of our political community. Based on Article 3 of the Constitution, all North Koreans, regardless of their situation or location, hold legal status as citizens of the Republic of Korea. It is a constitutional issue as a relation of fundamental rights between the Republic of Korea. The starting point for the interpretation and operation of the North Korean Refugee Support Act is to prepare living conditions and environments that can truly be integrated into South Korean society, with North Koreans recognizing the meaning and purpose of guaranteeing fundamental rights as South Korean citizens. There is a contradictory assessment of the procedures related to the recognition of medical qualifications of North Korean defectors in South Korea. In light of the peculiarities of medical practices that protect the lives and health of the people, the differences in positions regarding recognition of medical qualifications are fully acceptable. However, the national level of protection and assistance provided by the North Korean Refugee Support Act to help North Korean defectors settle in South Korean society and establish their identity as citizens also has constitutional values and status such as protecting people's lives and health. Despite differences in the political system, socioeconomic system, and education system of West and East Germany from the division to the completion of the unification process, I think it has much to suggest to us that Germany actively embraced East Germans by emphasizing common ground rather than differences.
