외국인투자로부터 국가이익을 보호하는 방향으로 주요국의 법령이 빠르게 변화하고 있다. 미국과 호주는 외국인투자에 대한 신고 및 심사체계를 수립한 후 이를 수정⋅보완하고 있다. 유럽연합은 외국인직접투자에 대처하기 위한 규정을 제정하였으며 각 회원국은 이에 따른 법령을 재정비하고 있다. 중국과 일본도 같은 방향으로 법제를 정비하였으며, 영국은 새로운 외국인투자법을 제정하였다 이에 주요국의 법령 변화에 발맞추어 우리도 외국인투자 심사체계를 강화해야 할 시점이다. 주요국들은 외국인투자 규제의 범주에 주요 관련 기술⋅데이터⋅분야⋅부문 등을 확대하고 있다. 4차 산업혁명에 따른 빅데이터, 인공지능, 블록체인, 5G 기술 및 ICT 등의 혁신적 변화가 앞으로 각국의 이익을 위협할 수 있다는 점에서 최근 주요국들이 관련 법령을 개정했다고 볼 수 있다. COVID-19는 독일⋅프랑스⋅일본의 외국인투자법 개정에도 영향을 미쳤다. 우리도 국가안보 이외에 첨단기술 주요 기반시설 및 데이터를 보호하기 위한 법적 근거를 마련하여 외국인투자의 규제대상을 확대해야 할 것이다. 또한 우리도 COVID-19의 심각성을 고려하여 국민의 건강을 보호하고 의료 및 생명공학 분야의 법인이나 기업을 보호하기 위한 규정을 마련해야 할 것이다.
The laws of major countries are rapidly changing in the direction of protecting national interests from foreign investment. The U.S. and Australia have established a system for reporting and reviewing foreign investment, and are revising and supplementing it. The EU has enacted regulations to deal with foreign direct investment, and each member state is reorganizing laws and regulations accordingly. China and Japan have revised their legislation in the same direction, and the UK recently enacted independent foreign investment control laws. Accordingly, it is time for Korea to reinforce the foreign investment screening system to keep pace with changes in laws and regulations in major countries. Major countries are expanding major related technologies, data, fields and sectors in the category of foreign investment regulation. It seems that major countries have recently revised related laws in that innovative changes such as big data, artificial intelligence, blockchain, 5G technology, and ICT following the 4th industrial revolution may threaten the interests of each country in the future. COVID-19 also affected the revision of foreign investment laws in Germany, France and Japan. In addition to national security, we should also prepare legal grounds for protecting key technologies, major infrastructure and data to expand the subject of foreign investment regulation. In addition, taking into account the seriousness of COVID-19, we must prepare regulations to protect the health of the people and protect legal entities and businesses in the medical and biotechnology sectors.
