다종교․다민족․다언어․다문화로 대표되는 네팔의 특수성은 시민권 법제 변화의 특징 분석을 통해 정치적 근대화의 다양한 형태의 하나로 분석할수있다. 시민권은 보편적 인격과 특정 공동체의 주권적 자기결정을 통해 역동적으로 협상되는 개념이다. 지난 70여년 간 네팔의 변화 속에서 시민권의 법제가 변화한 양상을 추적하여 현재 네팔에서의 논의 지형과 문제점을 분석할수 있을 것이다. 본 논문은 네팔의 시민권법과 헌법의 제․개정 과정을 연혁적으로 분석하여 시민권 법제의 흐름을 보여주고 있다. 네팔 시민권 법제의 특징을 분석하고, 특별히 최근에 네팔에서 시민권과 관련된 논의를 소개함으로써 네팔 시민권법제의 흐름과 현재를 보여주려 하였다. 네팔 시민권 법제는 여성을 통한관계자의 시민권 취득에 있어서의 차별성, 이중국적을 인정하지 않는 등 폐쇄성 및 법제 정비의 필요성을 그 특징으로 한다. 네팔 시민권 법제는 전통과 관습 및 헌정 변화에 따른 평등과 개인존중 등이 부딪히며 네팔 정치 공동체를 구성하는 시민의 경계를 형성하고 변경하고있다. 이 역시 정치적 근대화의 한 형태이다. 즉, 근대 사회의 정치적 조건 속에서 시민권 법제를 중심으로 네팔 정치공동체의 동태성을 다스리는 현재의기획 형태이다. 변화가 필요한 부분들 역시 스스로 성찰하여 그 공동체의 시민됨의 경계에 있는 역동성을 담아 시민권을 조정하여야 할 것이다.

Nepal, represented by multi-religion, multi-ethnic, multi-lingual, and multi-cultural, can be understood as one of the various forms of political modernization, through the analysis of changes in the citizenship law. Citizenship is a concept dynamically negotiated between universal human rights and sovereign-determination of a particular community. It is possible to analyze the current state by tracking the changes in the citizenship law amid the changes in Nepal over the past 70 years. This paper shows the flow of the citizenship law by the historical process of enacting and revising the laws and constitution related to citizenship in Nepal. Studying the characteristics of the citizenship law in Nepal, and in particular, by introducing the recent discussions related to citizenship in Nepal, the flow and current state of the citizenship law in Nepal can be analyzed. The Nepalese Citizenship Law is characterized by differentiation in obtaining citizenship through gender, closedness, and the necessity of legal reform. The citizenship law in Nepal is facing changes in tradition, customs, by the equality and respect for individuals resulted to the constitution. This, too, is a form of political modernization. In other words, it is the current form of the political modernization project that governs the dynamics of the Nepalese political community, centering on the citizenship law, in the political conditions of modern society. Areas that need to be changed also reflect on their own and adjust citizenship by embodying the dynamics in the boundaries of citizenship of this community
