통일을 대비하여 북한의 보건의료의 지원 및 협력을 증진시키기 위해서는 여러 가지 노력도 중요하지만 통일의 일차적인 완성은 남북한간의 법제 통합 즉 법의 통일이라고 할 수 있는데 이는 남북한의 보건의료법제가 보건의료정책의 기본과 이념, 그리고 보건의료행정조직을 규정하고 있기 때문이다. 그러나 남북한간의 법제 정비 내지 통일은 남북한이 서로 이질적인 체제하에서 법의 체계도 다르고 효력도 달리 부여되고 있는 상황에서 보건의료협력에 관한 법제가 남북한의 입법을 어떻게 설계하여야 하는 문제는 극복해야 할 과제로 남아 있다. 이처럼 남북한간의 보건의료분야에 대한 교류협력과 통합을 위한 법제도는 단기간에 한꺼번에 이루질 수는 없고 단기, 중기, 장기로 단계적 접근방법이 유용하다. 그리고 남북한간의 법제 지원 및 교류는 우리의 일방적 의사로서 수혜적 입장에서 우리의 법제를 강제이식하려고 하여서는 진정한 법제 통합은 이루어지지 않을 것이다. 본고는 통일을 대비하여 행정법적인 관점에서 북한의 보건의료법제가 가지고 있는 보건의료의 원칙과 특징을 분석한 다음 북한의 보건의료지원 및 협력에 관한 법제를 제정하기 위한 전단계인 남북한 보건의료 회의나 선언들의 내용들을 검토한다. 이런 검토를 바탕으로 남북한이 보건의료에 관한 초기단계의 법규범이라고 할 수 있는 보건의료협정안의 내용을 분석하고 이를 토대로 궁극적으로는 남북한 보건의료법제를 통합하는 내용을 제시하고자 한다.
While various efforts are important to promote the support and cooperation of health care in preparation for unification, the primary completion of unification can be called the integration of laws between the two Koreas, or the unification of laws, as the health and medical legislation of the two Koreas stipulates the basic principles and ideology of health care policy and the organization of health and medical administration. However, the issue of how the health and medical cooperation legislation should be designed remains a task to overcome at a time when the two Koreas have different systems of law and have different effects under different systems. As such, the legislation for exchange, cooperation and integration in the health and medical sectors between the two Koreas cannot be achieved at once in a short period of time, and a phased approach is useful in the short, medium and long term. And the support and exchange of legislation between the two Koreas will not really be integrated if we try to forcibly transfer our legislation from a beneficial standpoint as our one-sided doctor. In preparation for unification, the institute analyzes the principles and characteristics of health care in North Korea from an administrative legal point of view and examines the contents of inter-Korean health and medical conferences and declarations, a precursor to enacting legislation on health care assistance and cooperation in the North. Based on such a review, the two Koreas will analyze the contents of the Health and Medical Agreement, which can be called an early-stage code on health and medical services, and present a plan to eventually integrate the two Koreas' health and medical laws based on the basis of it.
