드론은 신기술과 결합하여 새로운 부가가치를 창출 하는 등 드론의 업무 범위는 점차 확대될 전망이다. 경찰 내부에서도 드론이 경찰장비인지에 관하여 「경찰관직무집행법」에서는 명백한 근거를 찾을 수 없지만, 경찰청 훈령에 수색과 구조업무에 드론을 사용할 수 있다고 규정하고 있는 것으로 보아 드론을 경찰장비로 간주하는 것으로 보인다. 드론 항공촬영 기술이 국가기관 업무에 활용된다면, 인력·시간·비용 등의 낭비를 줄일 수 있다. 하지만 이를 남용하여 국민의 기본권을 침해하면, 심각한 사회적 문제로 확대될 것이다. 때로는 드론이 신체적·재산적·정신적 손해를 입히기도 하며, 나아가 사생활 침해 문제를 발생시킨다. 더욱이 이 문제를 해결하기 위한 개인정보보호에 관한 법적 규제가 미비하다. 드론 항공촬영에 따른 개인정보보호와 관련하여 ‘영상정보처리기기’는 법적으로 배제된다. 따라서 이를 규제할 명확한 법적 근거가 없다. 결과적으로 개인영상정보 보호를 위해 구체적으로 적시된 규정이 없다. 따라서 이 연구에서는 경찰장비로서 드론 이용으로 인한 개인영상정보 보호를 중심으로 인간의 존엄성과 가치 및 사생활의 비밀과 자유를 근거로 보장하는 개인정보자기결정권 등 헌법적 기본권이 실질적 보장될 수 있게 함이 목적이다. 이러한 연구목적을 실현하고자 드론 항공촬영의 특징과 개인영상정보 보호의 보호 필요성 등을 검토하여 법률과 명확한 개념의 부재의 한계를 통해 관련 규정의 법률개선을 검토하고자 한다.
The scope of the drone's work is expected to gradually expand, with new technologies combined to create new added value. Even inside the police, there is no clear evidence in Act on the Performance of Duties by Police Officers regarding whether drones are police equipment. However, given that the National Police Agency instruction stipulates that drones can be used for search and rescue operations, it seems to regard drones as police equipment. If drone aerial video shooting technology is used for work at national organizations, waste of manpower, time, and cost can be reduced. However, if it is abused to violate the basic human rights, it will escalate into a serious social problem. Sometimes drones cause physical, property, and mental damage. Furthermore, it creates a problem of invasion of privacy. However, there are insufficient legal regulations on personal information protection to solve this problem. 'Video Information Processing Devices' are legally excluded in relation to personal information protection following drone aerial video shooting. Therefore, there is no clear legal basis to regulate this. As a result, there is no direct regulation for the protection of personal video information. Therefore, the purpose of this research is to ensure that basic human rights such as the right to self-determination of personal information, which are guaranteed based on human dignity, value, and privacy, are practically guaranteed, focusing on protecting personal video information through the use of drones. To realize this purpose of research, we will review the characteristics of drone aerial video shooting and the need for protection of personal video information to study the legal improvement of relevant regulations through the limitations of the absence of laws and clear concepts.
