본 연구는 2020. 3. 1. 개정·시행된「학교폭력예방 및 대책에 관한 법률」과 관련하여 처분기관으로서 학교에서 구성·운영되던 ‘학교폭력대책자치위원회’와 처분에 대한 불복기관으로서‘행정심판위원회’의 운영에 대하여 행정심판위원회의 실제 재결사례를 중심으로 하여 검토하였다. 연구결과, 첫째 학교폭력의 유사 사안에 대해 학교별 처분양형에 차이가 있어 자치위원회의 신뢰도나 공정성을 저해하는 경우도 있었으나 이는 법개정 이후 교육지원청에서 구성·운영하게 되는 심의위원회를 통해 보완될 수 있을 것으로 판단된다. 둘째, 법 개정 이후 각 지역의 심의위원회와 행정심판위원회를 효율적으로 운영하기 위하여 인력의 증원 및 배치가 필요하며, 셋째, 행정심판의 청구나 취소에 대한 기준이나 규정 등이 없어 불필요한 행정력의 낭비를 초래하고 있는 경우가 많았다. 넷째, 집행정지 청구에 대하여 실제적인 인용비율이 증가하고 있으며, 다섯째 행정심판 재결 후 이행 여부 등에 대한 관리가 부족하다는 점을 알 수 있었다. 그리고 행정심판의 유연한 운영을 위하여「행정심판법」의 ‘조정’ 기능을 활용하는 방안 검토, 행정심판위원회 관련 통합 프로그램 운영, 학교폭력 신고의 기한 및 규정 설정, 행정심판청구 및 취소의 기준 적용 등을 제언하였다.
This study is to investigate「Act on the prevention of and countermeasures against violence in schools」revised and implemented in March 1. 2020., the problems and improvements of the ‘School Violence Autonomous Committee' and 'Administrative Judgement Committee', which were organized and operated in schools as disposal agencies, were reviewed and searched, focusing on the case of the committee's judgements. As a result, First, there was a difference in the disposition of school-based in similar cases, which hindered the reliability and fairness of the Autonomous Committee but this is expected to be supplemented through the deliberation committee, which is established in district office of education. Second, it is necessary to increase and deploy the professional manpower for efficient operation the deliberation committee and administrative committee. Third, In order to prevent the indiscriminate appeals and cancellations, unnecessary consumption of administrative power, it is necessary to review the application of appropriate standards or restriction for administrative appeals and cancellations. Fourth, the actual recognizing ratio for the suspension of execution is increasing. Fifth, it was found that the management was insufficient due to the implementation of the administrative committee judgement. In addition, the use of the ‘adjustment’ function of the「Administrative appeals act」was presented for the flexible operation of the administrative committee.
