한국의 지방자치의 발전과정에서 지방의회의 기능과 역할은 우리 「헌법」과 「지방자치법」상 근거에 의할 때 집행부인 지방자치단체장과 비교할 때 강시장-약의회 구도로 형성되었다. 지방의회는 집행부인 지방자치단체장에 예속되어 지방자치단체장의 주도적 권한과 역할에 함몰되어 제기능과 역할을 수행하지 못하여 형식상의 지방의회의 기능과 역할을 수행함에 그쳐온 것이 현실이다. “지방의회의 자치입법기관으로서의 의회기능 회복방안에 관한 연구”를 위해서는 국내 및 해외사례로서 지방자치와 관련된 「헌법」 및 「지방자치법」의 근거규정과 중앙정부로부터 지방자치단체로의 사무 및 재정의 위임의 확대에 따른 지방분권의 과정에 대한 분석이 필요하다. 지방자치의 발전과정 속에서 지방자치단체장과 비교하여 지방의회가 어떠한 기능과 권한을 수행해왔는지의 사례와 지방의회의 기능과 역할의 강화를 위한 지방자치제도의 발전사례에 대한 분석을 통하여 지방의회가 제기능과 역할을 수행할 수 있는 지방자치에 대한 모범사례를 제시하고자 한다. 이를 위해서 본 연구에서는 지방의회의 자치입법권의 확대 및 지방의회 자치조직권의 확대를 위한 부분에 중점을 두고 「헌법」 및 지방자치관련 법제개선안을 제시하여 지방의회의 기능과 역할의 회복방안을 제시하고자 한다. 지방분권형 「헌법」과 지방분권형 「지방자치법」 및 지방자치관련 법령의 개정을 통하여 지방의회의 자치입법기관으로서 의회기능의 회복방안을 제시하여 주민의 실질적 자치실현과 지방자치의 효율성 달성에 기여함으로써 「헌법」상 지방자치의 적극적 실현을 위한 단초를 마련하고자 한다.
The reality is that the functions and roles of local councils in the process of developing local autonomy have been subjugated to the head of local government in comparison to local governments, which are the executive branch, and local councils have only played formal roles because local governments have played a leading role. In order to "A Study on the Functional Restoration of Local Council as a Local Legislative Institution", the local council shall be able to perform its functions through the analysis of various cases for strengthening the functions and roles of local councils in the process of decentralization and the development of local autonomy accompanying the central government as domestic and overseas cases. First, It is analyzed that the reason for limiting functions and authority of local councils is that functions and authority are concentrated on the heads of local governments. Second, it is analyzed that the reasons for limiting the function and authority of local councils are concentrated on the heads of local governments based on the Constitution and the Local Autonomy Act. Third, as a measure for the restoration of functions and authority of local councils, the method of dispersion of authority within local governments is analyzed. The measures proposed through the above study suggest how local governments transfer their authority to restore the functions and authority of local councils. The final solution for the restoration of functions and authority of local councils will be the revision of the decentralized Constitution and the Local Autonomy Act.
