2019년 12월에 처음 보고되어 세계적 대유행(pandemic)이 된 신종 코로나바이러스 감염증(코로나19)은 지구촌 산업 현장에도 엄청난 영향을 미치고 있는 중이다. 여기에 제4차 산업혁명의 진행이 맞물리면서 글로벌 자동차 시장에도 일대 변화가 찾아오고 있다. 사회의 모든 분야에 비대면 요구가 거세지면서 자동차 산업도 이전과는 다른 방향에서의 기술 발전이 더욱 촉진될 것으로 예측된다. 흔히 제4차 산업혁명의 핵심적 요소로 인공지능과 빅 데이터, 사물인터넷, 클라우드 등을 든다. 이 가운데 인공지능 기술은 그 발전의 끝을 알 수 없을 정도로 변하고 있다. 문제는 인공지능에 대한 관심이 유례없을 만큼 높아진 현실에서 그와 관련된 흥미로운 이슈들이 많이 등장하고 있다는 점이다. 특히 윤리적인 문제와 법적인 문제가 야기되었을 경우에 사람들은 관심은 더욱 크게 증가하고 있다. 이 글의 주제인 자율주행 자동차 관련 법적 이슈도 마찬가지이다. 운전자라면 누구나 가지는 교통사고 방지를 위한 주의의무라든지 도로교통 규칙 준수의무 등에 대해서 더욱 세심한 논의가 진행되어야 할 것이다. 그럼에도 불구하고 제도의 정비에 대한 목소리는 자율주행 자동차의 상업화와 제조사의 상업적 이익을 극대화하는 방향이 더 크게 들린다. 때때로 사회생활이라는 현실 속에서 법적 문제는 그 해결보다는 회피하는 쪽으로 다루어진다. 이 글은 이 같은 현실을 바탕으로 자율주행 자동차의 교통사고 사건을 통해 자율주행 자동차 운행으로 발생할 법적 책임과 그와 관련한 문제들에 대해서 다루었다. 인공지능 시대에 자율주행자동차가 등장하면서 이제 자동차의 개념도 새롭게 설정하여야 할 것이다. 법적인 면에서 자동차 사고와 관련한 경우에 특히 문제가 발생할 수 있는데 대체로 그 책임의 정도를 가늠하기 위한 논의가 중심이 된다. 자율주행자동차는 “운전자는 탑승하지만 목표지점을 설정한 다음에 인위적인 조작 없이 스스로 주행환경을 인식하고 운행할 수 있는 자동차”를 말한다. 이러한 자율주행자동차가 사고를 일으켰을 경우 법적 책임 소재는 복잡한 문제다. 운전자와 자동차 업체뿐만 아니라 사고 원인을 제공할 수 있는 주체가 매우 넓어지기 때문이다. 기계는 인간이 아니다. 인간이 그런 것처럼 기계도 실수하고 사고를 일으킨다. 실제 사회에 존재하는 수많은 자동차 사고에 대한 상황과 변수를 기계적 프로그램의 체계 안에 수렴하는 것은 거의 불가능에 가깝다. 여전히 규제와 발전이라는 경계에 서 있는 셈이다.

As the demand for non-face-to-face increases in all sectors of society, the automotive industry is expected to further promote technology development in a different direction than before. The core elements of the Fourth Industrial Revolution are AI, big data, the Internet of things, and the cloud. Among them, AI technology is changing so that the end of its development can not be known. The problem is that the interest in AI has increased to unprecedented levels, and there are many interesting issues related to it. Interest is growing even more when ethical and legal issues arise. The subject of this article is also the legal issues related to autonomous vehicles. More attention should be paid to the driver’s obligation to prevent traffic accidents and the obligation to comply with road traffic regulations. Nevertheless, the voices for the maintenance of the system seem to maximize the commercialization of autonomous vehicles and the commercial interests of manufacturers. Sometimes, in the reality of social life, legal problems are dealt with rather than solving. Based on this reality, this paper examines the legal responsibilities and problems related to the autonomous driving of the autonomous vehicles through traffic accidents. In the era of AI, the concept of automobiles must change as autonomous vehicles appear. In legal terms, various problems can arise in the case of automobile accidents. In particular, when an autonomous vehicle causes an accident, legal liability is a complex issue. This is due to the widespread availability of drivers and vehicle manufacturers as well as the likely sources of accidents. Machines are not human. Like human beings, machines make mistakes and cause accidents. It is almost impossible to converge the situation and variables of many automobile accidents in the actual society into the system of the mechanical program. It is still standing at the boundary of regulation and development.
