최근 미(美)에 대한 관심이 점차 높아지고 그 기준이나 유행도 급속히 변화하는 가운데 미용업 내지 미용시술의 범위와 영역도 확대되고 있다. 그에 따라 미용업 관련 분쟁사례도 계속 증가하고 있으며, 미용시술에서의 사고는 소비자분쟁조정으로 해결되는 것이 보통이지만 실제 소송으로 진행되는 경우도 적지 않게 발생하고 있다. 미용시술 과정에서 발생한 분쟁을 법적인 방법으로 해결하는 경우에, 미용사에게 처벌이 따르는 형사책임의 문제와 미용사에게 손해배상을 부담시키는 민사책임의 문제로 대별할 수 있다. 본고에서는 먼저 미용서비스 분야에서 발생하는 고객의 피해와 그 구제방법을 살펴보고, 미용시술사고에 대한 미용사의 법적 책임의 문제를 몇 가지 유형으로 구분하여 실제 소송으로 진행된 분쟁사례와 그에 대한 법원의 판단을 검토한다. 이어서 미용시술사고에서의 민사법적 책임을 중심으로 미용사의 채무불이행으로 인한 계약책임과 불법행위에 따르는 손해배상책임, 그리고 미용보조자나 고용한 미용사의 행위에 대한 미용업주의 책임을 고찰한다. 미용사와 고객 사이에 법적 분쟁이 발생한 후 미용사가 부담하게 될 민사책임의 측면을 고려한다면, 미용시술을 행하는 미용사의 입장에서는 손해배상책임을 면하거나 배상액의 감경을 위하여 미용유형에 따른 업무상 주의의무를 충실히 이행해야 할 뿐만 아니라, 시술방법의 효과와 부작용 또는 고객의 특이체질 등 모든 사정을 종합적으로 고려하여 피해방지를 위해 필요한 최선의 방법을 선택해야 할 것이다. 만약 고객에게 피해가 발생하였을 경우에는 그 피해가 미용사 자신의 과실에 기인하지 않았다는 것을 스스로 증명할 수 있도록 미리 대비하여야 하고, 특히 안전성이 확인되지 않았거나 부작용이 수반될 수 있는 미용시술을 행하는 경우에는 고객에게 그러한 사정을 설명하고 고객의 승낙을 얻도록 함으로써 고객의 자기결정권이 침해되지 않도록 주의해야 한다.
Appearances have recently become important as a criterion for evaluating people, and interest in beauty has gradually increased. Under these circumstances, the area and scope of Beauty Art Industry and beauty treatment are also expanding, and as a result, conflicts between hairdressers and customers are occurring. If an accident in cosmetic surgery cannot be resolved by agreement between the parties or by consumer dispute settlement, it will eventually attempt to resolve it through the law. The legal method can be distinguished from the question of criminal responsibility that the hairdresser is punished with and civil liability that causes the hairdresser to bear damages. In this study, we first look at cases of disputes that have been carried out in actual litigation and the court’s judgment on them. The legal responsibilities of hairdressers are reviewed professional negligence of hairdressers, transfer of hair salons, prohibition of competitive transaction, and liability of hairdressers for damages. In particular, the civil responsibility of hairdressers in beauty treatment accidents is problematic, such as liability for damages caused by default or illegal behavior, and responsibility of hairdressers for the actions of beauty assistants or hired hairdressers.
