원양산업은 단순 어획의 가치를 넘어 경제적 이익, 식품공급 안전, 외교 전략 등 국가 차원에서 중요한 전략적 의미를 내포하고 있다. 원양산업의 성장 배경은 ‘공해자유원칙’체제 하에있다. 그러나 최근 이러한 공해 어업관리체계를 개편하기 위한 새로운 국제어업질서 논의가 본격화 되고 있어, 우리 원양산업에도 새로운 대비가 필요해 보인다. 인간의 과도한 해양이용으로 인해 국제사회는 범지구적 차원에서 해양의 지속가능성을 보장하기 위한 규제 마련의 필요성을 제기했다. 이에 유엔은 유엔해양법 하에 ‘국가관할권 이원지역의 해양생물 다양성 보존 및 지속가능 이용(이하 BBNJ)’논의에 착수하여 국제법상 구속력 있는 국제문서 성안을 통해 새로운 체제를 준비하고 있다. BBNJ 논의는 4가지 패키지 이슈(해양유전자원, 지역기반관리수단, 환경영향평가, 능력배양 및 해양과학기술이전)를 중심으로 진행 중이다. 이 중, 원양산업과 직접적으로 연관이 있을 것으로 예상되는 이슈는‘해양보호구역을 포함한 지역기반관리수단’으로, 해당 문안이 형성된다면 이미 지역수산관리기구로부터 각종 규제를 적용받고 있는 원양업계에 또 다른 규제로 적용할 가능성이 크다. 따라서 본고에서는 국가관할권 이원지역의 개요와 유엔 BBNJ의 논의 배경과 주요 쟁점을 살펴본다. 또한 국가관할권 이원지역 어업관리 체계와 주요 지역수산관리기구 및 공해 어업규제현황, 그리고 국가관할권 이원지역 내 국내 원양산업 현황을 분석한다. 또한, 유엔 BBNJ 논의에관한 국내 원양업계 설문조사를 실시 결과를 토대로 향후 BBNJ 논의에 대비한 우리나라 원양산업의 시사점을 결론으로 제시하고자 한다.
In addition to its simple catch value, the distant-water fisheries(DWF) industry has importantstrategic implications at the national level, such as economic benefits, food supply safety anddiplomatic strategies. The background of the growth of the DWF industry is under the principle ofFreedom of the High Seas. However, recently, a new international fisheries order is being discussedin order to reorganize the fishery management system in the high seas, so it is expected that a newpreparation will be needed for the DWF industry in Korea. Due to excessive human use of the ocean, the international community has raised the need toestablish regulations to ensure the substantiality of the ocean at a global level. In response, the UNundertook the discussion on “Conservation and Sustainable Use of Marine Biological DiversityBeyond Areas of National Jurisdiction(BBNJ)” under the UN Convention on the Law of the Sea,and is preparing to establish a new system through legally binding international documents underinternational law. The discussion of BBNJ is proceeding around four package issues (Marine geneticresources, Measures such as area-based management tools, Environmental impact assessments,Capacity-building and transfer of marine technology). Of these, the issue that is expected to bedirectly related to the DWF industry is 'Measures such as area-based management tools'. If the textis officially formed, it is highly likely to be applied as another regulation to the DWF industry,which is already subject to various regulations from RFMO. Therefore, this study examines the outline of the areas beyond national jurisdiction, thebackground of the UN BBNJ discussions, and major issues. Also, the analysis of the fishingmanagement system in the areas beyond national jurisdiction and the status of the Korean DWFindustry was conducted. In addition, this study conducted a domestic industry survey on thediscussion of the United Nations BBNJ to draw implications for the Korean DWF industry inpreparation for the future BBNJ discussion.
