FAO는 올해 3월, 1분기 ‘작황 전망과 식량 상황 보고서’에서 북한을 식량 부족국가로 재지정하였고 WFP와 UN OCHA는 북한 전체 인구의 약 40%에 근접하는 1천만 명의 주민들에게 인도주의 지원의 필요성을 확인하고 있는 바, 북한의 광범위한 취약계층에 관한 남북한 인도주의 협력은 다음의 세 가지 측면에서 검토되어야 함이 타당하다. 첫째, 통일 지향의남북한 경제공동체 실현을 위해 단계적으로 선행되어야 하는 우선 과제라는 점, 둘째, 한국은 OECD DAC 회원국으로서 국제사회의 책임있는 공여국의 역할을 부여받고 있으며, 이는 북한에 있어서도 예외가 될 수 없다는 점, 셋째, 협력의 목적이 정치적 현안을 고려한 재량적 여지에 따라 훼손되지 않고, 일의적으로 지속성을 담보하기 위한 제도 마련의 시급성이상당하다는 점이다. 본 연구는 국제사회의 대북제재下 지속가능한 남북한 인도주의 협력을 위한 우리정부의제도적 개선 방안 도출을 목적으로 관계 법령을 검토하였다. 연구 방법으로 ① 남북한 간 체결된 선언문·합의서 ② 국내법적으로 유효한 법령, ③ 계류·폐기된 20대 국회 발의법안으로구분하여 대북 인도적 지원 관련 법취지·조문 및 법현실을 검토한 후, 지속가능한 남북 인도주의 협력을 위한 대안적 법제화를 모색하였다. 과거 수원국에서 공여국으로 성장한 한국이 국제 인도주의 규범을 준수하는 모범국가로서, 남북한 인도주의 협력간 일관성과 지속성을 담보하게 된다면, 북한 인도주의 협력의 대외적 환경 개선을 주도하는 연대주의(solidarism) 촉진자로 기능할 수 있을 것이다.
The purpose of this study is to find out the institutional improvement plans of the Korean government for sustainable development cooperation in North Korea. Humanitarian development cooperation on vulnerable groups in North Korea is important in two respects. Firstly, it is a priority task to be preceded in order to realize the economic community of South and North Korea in a phased manner. Second, Korea needs to be a responsible donor country of the international society as a member of OECD DAC. The research method is mainly divided into the declaration agreed between the two Koreas, the legislation which is effective in Korea, and the pending legislation. As a result of the study, first, it suggested the utilization and maintenance of existing laws and ordinances, the second, the special humanitarian exemption legislation step by step, and the second, the necessity of amendment of the special law of humanitarian exemption. The Korean government, which has experienced both the recipient country and the donor country, needs to lead sustainable development cooperation as a model country that adheres to humanitarian norms of the international community. It would be a facilitator to improve the institutional environment of North Korean development cooperation under international sanctions sanctions.
