자치경찰제가 도입되면 자치경찰은 사실상 지자체장의 사병이 될 것이라는 우려가 적지 않다. 지방공무원에 대한 지자체장의 과도한 인사권과 위계적 승진구조로 인한 지방공무원의 줄서기 현상이 자치경찰제에서도 나타날 것이라는 우려다. 또한 국가경찰에서처럼 자치경찰도 자신의 권한을 오남용할 가능성도 있다. 자치경찰제 도입을 위해서는 이러한 문제를 해소하는 것이 요구된다. 바로 민주적 통제 장치의 문제이다. 이러한 배경 하에 이 논문은 자치경찰의 경찰권이 국민의 경찰권이 되도록 하기 위한 다양한 통제 장치를 살펴본다. 특히 자치경찰제 도입 법률을 통한 통제, 시도 경찰위원회를 통한 통제, 자치경찰본부장에 대한 통제, 자치경찰의 경찰권 오남용 또는 정치화된 경찰활동에 대한 외부적 통제장치로서 경찰옴부즈만, 자치경찰의 수사에 대한 통제 등을 고찰한다. 다만, 자치경찰제 도입에서 분권화된 경찰의 정치화를 초래할 것이라는 우려와 경계에서 자치경찰제 도입을 거부하는 것도 경계되어야 한다. 왜냐하면 자치경찰에 대한 민주적 통제는 현행 국가경찰제의 민주적 통제 방안으로서 자치경찰제를 다시 민주적으로 이중 통제한다는 것을 의미하기 때문이다.
With the introduction of the local police system, there are few concerns that the local police will become a de facto soldier of the local government. There is also concern that the public officials' lineup in local government will also appear in the local police system. Also, as in the national police, local police have the potential to misuse their powers. In order to introduce the local police system, it is necessary to solve these problems. This is why democratic control is also important in the local police system. In this background, this study examines various democratic control devices to ensure that the local police force comes from the people. In particular, the democratic control through the police commission in provincial government and metropolitan, the police ombudsman as an external democratic control device, and the control of the investigation of the police police are considered. However, we must be wary of refusing to introduce the local police system due to excessive concern that the politicization of local police will result. This is because democratic control over local police means dual democratic control.
