장애아동의 학대는 자신을 보호할 수 없는 가장 취약한 대상에게 행해지는 반인륜적인 범죄이다. 본 연구는 이러한 장애아동을 대상으로 이루어지는 학대의 현황은 어떠하며, 장애아동의 학대와 연관된 법령을 살펴보고 이것을 근거로 장애아동 학대에 대한 현 수준을 파악하고자 하였다. 본 연구를 수행하기 위하여 연도별 아동학대 현황 및 장애아동 학대현황에 대한 조사결과를 참고하였으며, 또한 장애아동과 연관된 법령들이 장애아동의 학대에 대해 규정한 사항은 어떠한 지에 대해 알아보았다. 관련 자료를 분석한 결과 장애인에 대한 차별 금지와 아동학대범죄 처벌 등 학대와 관련된 법제도는 이전에 비해서는 많이 개선이 되었다고 할 수 있지만 장애아동에게 이루어지는 학대에 대한 규정은 아직도 보완할 점이 다수 존재하는 것으로 나타났다. 이러한 결과를 통해 향후 장애아동 학대에 대해 효율적으로 개입하기 위한 정책적인 개선방안이 논의되었다.
Abuse of a children with disabilities is an anti-human crime committed against the most vulnerable person who cannot protect themselves. The purpose of this study is to examine the current state of abuse of children with disabilities, and to investigate the current level of abuse of children with disabilities. In order to carry out the research, the results of the survey on child abuse status and abuse status of children with disabilities by year are referred to. As a result of analyzing the relevant data, the legal system related to abuse such as the prohibition of discrimination against the disabled and the punishment of child abuse crimes has been improved but the regulation on abuse for children with disabilities still appears to have many supplements. Through these results, policy improvement measures to effectively intervene in the future abuse of children with disabilities were discussed.
