4차 산업혁명의 도전은 인간의 생활방식과 업무방식, 그리고 인간관계를 맺는 방식까지 송두리째 바꿔 놓고 있는 것이다. 우리의 삶의 방식을 근본적으로 바꿀 수 있는 과학기술과 사회변혁 기회가 찾아온 것이다. 즉, 인공지능과 로봇, 빅데이터와 클라우딩, 3D프린팅과 퀸텀프린팅, 나노, 바이오 기술 등 지식정보기술 분야의 급속한 발전으로광범한 혁명이 일어나고 있는 것이다. 바둑, 체스, 퀴즈 분야에서 알파고가 인간의 최고실력자를 이기는 결과는 우리에게큰 충격을 주었다. 이제 인공지능 기술은 인지·학습·추론을 통해 인간의 구체적인 지시 없이도 스스로의 행동을 결정하여 활동할 수 있는 수준 이상으로 진보되어 가고 있다. 인공지능이 점차 인간을 추월하게 되면서 일정한 행위나 가치의 판단에 인공지능은주도적인 역할을 수행할 수 있다. 인공지능은 인간의 대리자·보조자를 넘어서 자립하여 인간과 유사한 법률행위를 할 수 있는 ‘행위자’로서 기능을 수행할 수 있을 것이다. 또한, 인공지능이 로봇, 빅테이터, 3D 프린팅, 사물인터넷 기술과 결합하여 인간을지시를 받지 않고 스스로 학습하여 창작한 지식재산의 권리귀속 등 재산권 문제와 인공지능의 오판에 따른 인적‧물적 손해에 대하 책임귀속 문제가 발생할 경우 어떻게 해결할것인가? 이제 4차 산업혁명과정에서 발생하는 법률문제를 해결하기 위해 새로운 법학연구가필요하다. 현행법의 한계를 극복하기 위해 비교법적 연구가 보다 활발히 이루어지고 법해석학적·법정책적 대안을 제시해야할 시점이다. 새로운 과학기술 분야를 뒷받침할 수있는 법제연구를 위해 과학기술 및 공학과 법학, 인문사회 과학과 법학간의 학제적인공동연구가 활성화 되어야 하고 정보를 공유하는 시스템이 구축되어야 할 것이다.

There are opportunities for science and technology and social transformation that can fundamentally change our way of life. In other words, a wide revolution is occurring due to the rapid development of knowledge and information technology such as artificial intelligence and robots, big data and clouding, 3D printing and quantum printing, nano and biotechnology The result of AlphaGo beating the best human talent in the field of baduk(Go), chess and quizzes has shocked us greatly. Now, artificial intelligence(AI) technology is advancing beyond recognition, learning, and reasoning to determine and act on its own without specific human instructions. As artificial intelligence gradually overtakes humans, it can play a leading role in determining certain behaviors or values. Artificial intelligence will be able to function as an "executive" who can go beyond human agents and assistants to stand on their own feet and engage in similar legal acts as human beings. AI is combined with robots, big data, 3D printing, and Internet of Things technology to protect human rights and property damages caused by misunderstandings of AI and intellectual property rights, including the right to intellectual property rights created by self-learning. How do you solve a problem of liability? New legal studies are now needed to solve the legal problems that arise during the Fourth Industrial Revolution. In order to overcome the limitations of current law, it is time for comparative law research to become more active and to provide alternative solutions for legal analysis and legal policy. Interdisciplinary collaboration between science and technology, engineering and law, humanities and social sciences and law should be activated and a system for sharing information should be established for legal research to support new science and technology fields.
