모사 작가의 작품은 많은 시간과 노력, 그리고 비용이 투입된 작품임에도 불구하고 모사 작품을 단순히 복제물로만 보아 원작과는 달리 저작권법상의 권리를 부여하지 않는 실정이다. 모사 작품에 대한 저작권 문제는주로 고미술품의 복원 과정에서 발생한다. 고미술품의 저작권은 이미 종료되었기에 모사 작가와 그 모사 작가의 모사 작품을 활용한 제 3자 사이에서 모사 작품의 저작권 분쟁이 발생하게 된다. 모사 작품의 저작권분쟁은 우리나라와 같이 다양한 형태의 고미술품이 많은 국가에서 발생할 가능성이 있는 이슈이며, 향후 고미술품의 복원을 위한 모사 작품의제작 활동이 활발해지면서 모사 작품에 대한 저작권 분쟁의 발생 가능성이 차츰 커질 것으로 예상된다. 본 연구에서는 우리나라에서 향후 발생할 수 있는 모사 작품의 저작권문제를 선행하여 일본의 판례를 통해서 조사하여 살펴보았다. 일본 판례들에 따르면, 모사 작품이 저작물성을 인정받기 위해서는 기계적 모사를하면 안 되고, 원작과 실질적으로 동일하지 않는 새로운 창작적 표현이모사 작품 속에 존재하여야 한다. 즉, 모사 작품도 저작물성을 인정받기위해서는 모사 작가의 창작적 행위가 그림 속에 발휘되어야 하는 것은일반적인 예술작품에서 저작물성을 인정받기 위한 것과 동일하다 할 수있다. 그러나 모사 작품의 세계에서 모사 작품이 원작과 실질적으로 동일성을 벗어나기는 태생적으로 상당히 제약적이다. 이러한 이유에서 모사작품의 저작물성을 판단하는 창작성은 일반적인 예술작품의 저작물성을판단하는 창작성과 비교하여 상대적으로 관대하게 인정하는 것으로 판단된다.
Although it takes a lot of time, effort and money, copy of a painting work do not give the rights under copyright law unlike the original work by looking at the copy work. The copyright issue on the copy of a painting work mainly occurs during the restoration of ancient works of art. Since the copyright of the old art work has already been terminated, a copyright dispute of the copy of a painting work occurs between the copy artist and a third party using the copy work of the copy artist. The copyright dispute of the copy of a painting work is an issue that can occur in many countries including korea with various forms of ancient arts, and the possibility of copyright disputes on the copy of a painting work gradually expected to increases as the production activities for copy of a painting work is actively made. In this study, Investigated precedents in Japan to investigate copyright issues in copying operations that may occur in Korea. According to Japanese precedents, in order for a replica to be recognized as a copyrighted work, mechanical copying must not be performed, and a new creative expression that is not substantially the same as the original must exist in the copy. In other words, in order for copy of a painting work to be recognized as a copyrighted work, the creative act of the copy artist must be exerted in the picture, which is the same as that of a work of art. However, in the copy work, It is essentially quite limited in that the copy of a painting work are substantially the same as the original. For this reason, the creativity of judging the copyright of the copy of a painting work is considered to be relatively generous compared to the creativity of judging the copyright of a general work of art.
