현행 정치자금법은 보다 투명한 정치를 목표로 국민의 요구를 반영하여 제안되고 시행되었음에도 정치현실을 반영하지 못하고 기득권을 가지고 있는 정당에 유리하게 작용하고 있어 정치개혁을 이루는데 방해가 되고 있는 것이 현실이다. 이러한 현실은 정치에 대한 불신을 바탕으로 정치자금에 대한 불법의 한도를 지나치게 확대함으로써 정치개혁을 저해하는 결과를 야기하였다. 유권자가 기부행위를 통하여 자신의 정치적 의사를 표현하는 것은 헌법 제21조에 의하여 표현의 자유 및 정치적 기본권 보장 차원에서 최대한 보장되어야 하지만 정치자금의 제공은 정치자금의 투명성 확보를 통하여 부정을 방지함으로써 정치발전에 기여함을 목적으로 하는 정치자금법의 목적과 충돌되어서는 안 되며, 양립 가능한 정책적 대안을 모색할 필요가 있다. 이와 같은 경직된 구조하에서 정치적 기본권의 보장이 최대한 이루어질 수 있는지에 대한 검토가 필요하다. 이를 실현하기 위한 제도보장이 어떠한 형태로 이루어져야 하는지를 살펴보기 위하여 미국, 영국, 일본의 정치자금제도에 대하여 검토해 보고자 한다. 정치자금의 비대화 및 운영상의 불투명으로 인한 위법의 문제를 해소하기 위하여 이와 관련한 외국의 운영사례 및 합리적 운영방안을 검토해 보고자 한다. 블록체인시스템을 활용한 정치적 민의반영과 운영상의 비용절감을 비롯한 투명성의 제고를 살펴보도록 한다. 이를 통해 정치현실을 반영하면서 정치적 기본권을 최대한 보장하는 방향의 정치자금제도 개선방안을 제시해 보고자 한다.
Although the current political fund law has been proposed and implemented to reflect the needs of the people with the goal of more transparent politics, it does not reflect the reality of politics and acts in favor of parties with vested interests, which impedes the achievement of political reform. This reality has resulted in disturbing political reforms by overextending the illegal limit on political funds based on distrust of politics. Under such a rigid structure, it is necessary to examine whether the guarantee of political fundamental rights can be maximized. In order to see what kind of system guarantee should be made to realize this, I would like to examine the foreign political fund system. In particular, let 's look at the political funding system in the United States, where the donation system is active. In order to overcome the problem of illegality caused by the enlargement of political funds and the operational uncertainty, it is necessary to consider the transition of the members of the local autonomous governments including the members of the parliament and the local governments to the unpaid honorary positions. I would like to review the plan. Let us examine the enhancement of transparency including the reflection of political people and the reduction of operational costs by using the block chain system. In this regard, I would like to suggest ways to improve the political funding system to maximize the political basic rights while reflecting the political reality.
