군사행정은 행정영역에서 큰 부분을 차지하고 있다. 특히 군사시설은 군사행정 중에서 국민들의 생활과 밀접한 관련을 가지고 있으며, 국민들의 커다란 관심의 대상이 되고 있다. 또한 군사시설 계획과 건설을 둘러싼 법적 분쟁도 늘어나고 있다. 따라서 군사시설 계획과 건설에 대한 법적 쟁점을 분석하고, 군사시설 계획과 건설에 대한 법적 검토를 종합적으로 할 필요성이 있다. 이에 따라 본 연구는 군사시설 계획과 건설에 대한 법리적 검토를 수행하였다. 군사시설 건설 분야는 과거 법률의 근거를 통하여 진행되지 아니하고, 내부의 계획이나 규정들에 의하여 진행되어 지방자치단체가 수립한 도시계획과 갈등이 발생하고 있다. 또한 환경영향평가 절차의 문제로 인하여 많은 갈등이 발생한다. 따라서 군사시설 계획의 법정화(法定化), 군사시설 계획과 국토․도시계획 연동제, 군사시설 구역제도, 군사시설 영향평가제도 도입을 통하여 군사시설 건설에 따른 법적 문제를 개선하여야 한다. 헌법상 국가안전보장의 목적을 위한 군사시설의 건설은 국민의 기본권과 재산권의 보장이라는 두 가지의 목적을 조화롭게 할 필요가 있다 향후 군사시설 건설에 있어서 법적인 불확실성, 갈등이나 분쟁을 줄이고, 군과 국민(주민), 군사시설과 도시가 조화되는 지속가능한 발전이 되어야 한다.
Military administration comprises a large share of public administrative areas. Military installations are deeply related to the general public compared to other military administration domains, with a correspondingly high degree of interest from general citizens. Legal disputes have been increasing in the area of military installation construction along with this interest. Therefore, there is a demand for analyzing the legal disputes in the constructing of military installations and for comprehensive legal review of the constructing of such installations. This study aims to investigate the legal review on military installation construction and its administration up to now. Military installation construction without legal basis has caused urban planning conflicts with local governments because military construction had been implemented with the military’s internal plans and regulations. Also, it has caused many disputes in procedures for environmental impact assessment. Therefore, there should be an improvement in mitigation protocols for legal problems in constructing military installations and legislating military installation plans. Furthermore, a linkage should be developed between military installation plans and national land and urban plans. Also, an impact assessment for military installation zones and military installations should be implemented to solve legal disputes in constructing military installations. Military installation construction for securing national security and ensuring human and property rights should be balanced to meet those two aims. In the future, we expect continuous development of military installations and urban cities with decreased disputes and conflicts in military installation construction and administration, which will create an environment of less legal uncertainty.
