본 연구는 장애인에 대한 강제격리를 폐지한 이탈리아의 바자리아(Basaglia)법 입법과 그 이후 장애인 탈시설 운동이 지역사회에서 어떻게 뿌리내렸는지를 검토하여, 장애인을 배제하고 비가시화했던 정신병원이란 수용시설이 해체되고 장애인이 협동조합을 통해 사람중심 노동과 새로운 관계망을 형성하는 과정을 분석한다. 이탈리아는 현재 전세계적으로 사회적 경제나 정신장애인의 탈시설 운동에서 새로운 모델로 주목받고 있다. 프랑코 바자리아라는 정신과 의사에 의해 도입된 바자리아법(법령 180호)은 1978년 제정되어 장애인의 정신병원 강제격리를 폐지한 탈시설의 선구적인 사례이다. 이탈리아에서 근대 초기부터 내려오던 정신장애인에 대한 강제격리를 폐지한 바자리아법은 이탈리아 68혁명의 자장 속에서 이루어진 급진적인 입법이었다. 본 연구에서는 강제격리의 페지와 탈시설의 과정을 수용시설이란 장치(dispositif)의 해체와 새로운 관계망의 복원으로 규정한다. 이는 사회에서 배제되고 비가시화되었던 장애인들이 호혜성에 기반한 사회적 관계역량을 회복하며 또한 단절된 관계망을 형성해가는 과정이다. 바자리아법 이후 이탈리아의 장애인 협동조합 운동은 기존에 객체화되고 대상으로 위치지워져, 인간의 권리를 박탈당한 장애인들과 소위 비정상으로 객체화되었던 이들이 사회와 새로운 관계를 맺을 수 있도록 매개하는 새로운 관계망을 형성한 대표적인 사회운동이다.
This study examines how the Basaglia legislation in Italy, which abolished the forced isolation of persons with disabilities, and the subsequent disability movement in the community, and analyzes the process of disadvantaged and disabled persons’ forming a new network of people-centered labor through cooperative movements. Italy is now attracting attention as a new model in the social economy and the disability movement of people with mental disabilities all over the world. The Basagila Act (Statute 180), introduced by a psychiatrist named Basaglia, was a pioneering example of deinstitutionalization in 1978, which abolished forced isolation of mental hospitals for people with disabilities. This was a radical legislation in the turmoil of the Italian 1968 Revolution. In this study, the process of repeal of forced isolation is defined as the dismantling process of the dispositif and apparatus of control and the restoration of new capacities and relations. This is a process in which disabled people, who have been excluded and invisible from society, are restoring their capabilities in reciprocal social relations and restoring disconnected networks. In the Bologna region of Italy, people with mental disabilities are forming a new relationship through the activities of people-centered labor and co-operatives rewriting the history of the control and confinements of hospitals.
