이 논문의 목적은 법관의 법적 확신의 토대가 되는 기본 개념으로서 객관성 경험의 개념을 해석주의라는 새로운 사유구도 하에서 정립하는데 있다. 우선 이 논고는 인간의 실존을 둘러 싸고 있는 근본적으로 서로 다른 세 종류의 세계의 장, 즉 물리적 대상 세계, 미적 체험의 세계, 그리고 사회적 행위의 세계 모두에 인간의 의지로 좌지우지할 수 없는 경험 영역이 있다는 점을 밝히고, 그러한 불수의성(不隨意性)의 경험을 객관성 경험의 1차적인 규정 근거로 확정한다. 그 다음에 그 규정 근거 위에서 의사소통을 통한 인간의 상호적인 행위 조정을 가능하게 하는, 모두에게 <열린> 경험 영역과, 관조적인 인식주관 자신에게만 혹은 그를 둘러싼 소수의 사람들에게만 공유될 수 있거나 그들에게만 유효한, <닫힌> 영역이 있다는 점을 밝히고, 전자의 특성, 즉 <열려 있음>의 특성을 객관성 경험의 2차적인 규정 근거로 확정한다. 이제 이렇게 규정된 객관성 경험의 개념을 가지고 사회적 세계 안에서 개별자인 인식주체들에게 객관성 경험으로 현상하는 소여들이 어떤 것이 있나 살핀다. 이렇게 볼 때 이른바 관습적인 규칙이나 관습법이라고 부르는 것, 즉 관행적인 형식 안에 들어가 있는 객관성 경험이 한 축에, 그리고 구체적인 상황 안에서 규범적인 사태로 파악되면서 개별자들에게 실천적인 필연성의 형태로 직접적으로 현상하는 객관성 경험들이 다른 한 축에 있는데, 이 논문은 하트가 정립한 가치중립적, 일반적 규칙 실증주의가 어떻게 자신의 잘못된 방법론적 전제에 매몰된 나머지 전자에만 실질적이며 학문적인 지위를 부여하고, 후자가 가져야만 하는 정당한 이론적 지위를 박탈했는지를 보여준다. 이렇게 하트의 방법론적 규칙 실증주의의 이론을 비판함으로서, 이 논문은 그 대안으로 실증주의를 대체하는 해석주의라는 새로운 길을 연다. 해석적 관찰자와 해석공간의 개념으로 대표되는 해석주의의 사유구도 안에서 후자의 객관성 경험이 어떻게 법관의 법적인 확신의 토대를 이루는 본질이 될 수 있는지를 암시하며 이 논문은 마무리된다.
The aim of this paper is the foundation of a new concept which will be called “Hermeneutism” and “Objectivity-experience” as an explanatory framework of judge’s legal conviction. First of all this paper divides The Three major Realms of human existences, which are the Physical-Object World, the World of Beauty (aesthetic perception) and the World of Social Action. There is “through and among” all these fields a certain area of mental experience, which man cannot control on his own will. This paper determines this quality as the first conceptual criterion of objectivity-experience. And then as a second conceptual criterion, this paper arguably determines its “open character”, through which men can coordinate his real action and interest with his fellow-citizens in his life-world. On the last stage this paper determines two categories of objectivity-experience in the world of human action and interaction: On the one hand the so-called conventional rule (which include conventional law and morality), On the other hand the bare inevitability(normativity)-experience in concrete situations, which appears prima facie in forms of strong normative feelings to the inner viewpoint of an each individual. Through the critic of methodological premise of H.L.A. Harts Rule Positivism, which in author’s opinion ended with fatal failure of the explanation of those third category of normativity-experience, this paper concludes with possibility of the new horizon of Hermeneutism.and hermeneutical thinking.
