오늘날 무연고사망자는 위생적･경제적 측면만을 고려한 ‘처리’와 ‘관리’의 대상으로 전락하고 있다. 망자의 존엄성을 지키기 위한 장례절차도 없다. 이에 본 연구는 무연고사망자가 존엄하게 삶을 마무리하고 세상과 이별할 권리인 ‘죽음권’을 근거로 무연고자의 죽음과 장례의례의 문제를 사회적 위험으로 인식하였다. 이러한 인식을 바탕으로 무연고사망자 당사자의 존엄한 삶의 마무리를 위한 ‘죽음권’ 측면에서, 가족과 지인의 ‘애도와 치유’의 관점에서 그리고 공동체의 ‘사회적 애도’라는 세 가지 주안점에서 무연고사망자 장례 실태 및 개선방안을 고찰하였다. 이를 통해 연고자가 없는 사람도, 재정적으로 어려운 사람도 공공이 최소한의 장례절차를 보장하고, 가족과 지인 그리고 사회와 이별할 수 있는 ‘공영장례의 제도화’와 가족이 아닌 지인 등도 장례를 할 수 있는 ‘가족 대신 장례’ 제도를 위한 법제도 개선 그리고 해마다 증가하는 무연고사망자의 예방과 대책을 위한 무연고사망자의 체계적인 통계관리 방안을 제시하였다. 향후에는 사회보장적 측면에서 무연고사망자 관련 정책에 대한 추가 논의가 필요하다.
The unclaimed dead have fallen so low as to be regarded as an object of ‘disposal’ and ‘management’ that no funeral process to keep the dignity of the dead exists. Therefore in this study recognized the death of the unclaimed dead and absence of appropriate funeral ritual as a social risks, and focused on the necessity of ‘death right’ which is the right to end oneself’s life with dignity. Stemming on such recognition, this study figures out the status of the funeral system of the unclaimed dead, and contemplates the need for a proper public funeral service system, primarily focusing on the perspective of ‘death right’ which is necessary for the unclaimed death’s dignified completion of life, the perspective of ‘healing and mourning’ of relatives and acquaintance, and the perspective of ‘social mourning’ of the community as a whole. With such methods, this study proposed a public funeral service system which can let the dead’s family, acquaintances, and society to bid farewell to the dead, and ensure a minimal qualification of funeral for the people who cannot afford their own funeral or for the people who do not have any acquaintance. Moreover, this study not only suggested an amelioration of legal system so that it can allow ‘instead of family funeral’ system but also suggested a statistic management plan that can prevent the number of unclaimed dead from increasing. Henceforward, further discussion of the unclaimed-death-related policy in the viewpoint of social security is required.
