본 논문은 1990년대 이후 일본의 파견법개정과정을 분석해 노동정책결정과정이 당파적으로 변화해간 과정을 밝힌다. 자민당정부는 온건보수주의 정책지향을 벗어나 신자유주의적 규제완화 정책을 추진하기 시작했다. 이에 노동정책 결정과정 역시 삼자협의를 중시하는 일본식 코포라티즘체제인 심의회 중심에서 벗어나기 시작했다. 정부주도 위원회가 심의회 안건과 방향을 주도했으며, 안건은 다시 국회에서 정당 간 힘 대결을 통해 수정되거나 강행 체결되었다. 그러므로 국회에서 노사 간 이해를 대변하는 정당들의 대결과 교섭이 매우 중요해졌다. 이에 내각을 차지하는 정당의 성격과, 중·참의원에서 역학관계가 파견법 수정에 있어 결정적 변수가 되었다. 이 과정에서 일본노동조합총연합회(日本労働組合連合会: 이하 ‘렌고’)는 일본민주당(日本民主党)과의 연계를 통해 네 번의 파견법 개정 과정에서 정책적 영향력을 행사하고자 했다. 본 연구는 세계화 과정에서 일본 노동정치과정이 당파적으로 변화해가는 사례연구로, 조직노동이 정당체제를 통해 대표되는 것이 여전히 중요하다는 점을 밝히고 있다. 즉 노동조합과 그와 연계된 정당은 신자유주의적 노동법제 변화 과정에서도 여전히 유의미한 영향력을 행사 할 수 있는 행위자라는 점을 보여주고 있다.
This thesis discovers that how the process of decision about labor policy became partisan, through the analysis of the revision process of Worker Dispatching Law(1999, 2003, 2012 and 2015, WDL) in Japan since 1990s. The Liberal Democratic Party of Japan(LDP) government has started to pursue the neo-liberalism policy for deregulation, breaking from moderate conservatism. Also, the process of labor policy also has started to be away from Japanese corporatism council which puts importance on Tripartite consultation, and agenda were revised or enforced to sign by the force of parties in the National Assembly. Therefore, the confrontation and negotiation of parties, which represent interests of labor and business, become important. Accordingly, the character of party occupying the cabinet and the dynamics of the House of Representatives and the Upper House are crucial variables for revision of WDL. In the process, Japanese Trade Union Cofederation-RENGO (JTUC) tried to exercise political leverage about the revision process of WDL four times, through the association with Democratic Party of Japan(DPJ). This research is case study about how Japanese labor politics becomes partisan and shows that it is still important for organized labor to be represented through political party system. In other words, this study demonstrates that trade union and the party associated with it, are still doers which exercise meaningful leverage even in the change process towards neo-liberalism.
