주민자치가 도입된 지 28년이 되고 있지만 여전히 한국의 주민자치는 형식적이고 관치적 요소가 강한 것은 무엇 때문일까? 그리고 앞으로 한국의 주민자치는 과연 어떤 이론적 토대위에 재설계해 나가야 할 것인가? 이에 대한 의문을 풀기 위하여, 지방자치권과 주민자치권에 대한 이론적 검토를 바탕으로 최근 개헌과정에서 주민자치관련의 규정을 어떻게 신설할 것인가와 현재의 주민자치관련의 제도적 논의의 문제점을 분석하여, 주민자치의 실질적 제도화를 위하여 어떤 처방을 내려야 하는가에 대한 제언을 제시하고 있는 논문이다. 자치권은 포괄성과 자주성을 가치로 지향해야 하는 것이고, 주민주권사상에 입각하여 제도화되어야 하는 것이다. 국가가 민주공화정이라면, 지방도 민주공화정의 원리에 따라서 자치권이 보장되어야 한다. 그리고 생활자치의 토대로서 동네자치와 커뮤니티 구역자치를 바탕으로 상향적으로 주민자치제도가 설계되어야 한다. 그럼에도 현행헌법과 지방자치법에서는 단체자치의 개념만 들어 있고, 주민자치의 가치와 제도가 형해화 되어 있다. 국회특위안에서는 주민자치권을 헌법조항으로 명시하여 총회제 자치를 도입하였으나, 대통령안에서는 참여권리만 제시하는데 그치고 있다. 비주민자치라고 할 현재의 상황을 타개하기 위해서는 주민자치권을 기본권으로서 헌법조항에 넣어야 하고, 집합주거단지에 대한 자치관리제도를 활성화시키고 확대 적용해야 한다. 행정통제관리제도인 읍면동을 폐지하고, 통리제도를 전면 개혁해야 한다. 대의제도만이 민주주의의 방식이라는 인식의 틀을 깨고, 총회제에 입각한 주민자치를 새롭게 설계해야 하고, 이것이 가능하기 위해서는 자치관리구역이 주민이 참여할 수 있는 규모와 단위여야 한다.
This study’ purpose is to analysis the cause why residents’s autonomy is perfunctory and controlled by bureaucracy although it has been introduced during 28 year. In the future, how does the Korean system of residents’s autonomy redesign on the orthodox theory? This study propose the real residents’s autonomy system and method to reform the current residents’s autonomy structure by the constitutional amendment and revision of local autonomy law. The right of autonomy is constituted of inclusiveness and independence and should be institutionalized on the residents sovereignty ideas. The system of residents’s autonomy should prepare the design of livelihood autonomy, namely neighborhood autonomy and district self-government. The current constitution and local law has been designed on the ideas of group autonomy and as a result, we can not find out the ideas of residents sovereignty. The suggestion of National Assembly’s special committee specify the residents sovereignty and introduce the autonomy of town meeting system. But the suggestion of the President’s constitution amendment does not include the ideas and method of the residents sovereignty. To innovate the current situation of non–residents-sovereignty, the new proposal of constitution amendment could contain the cause of residents sovereignty and vitalize and scale up the self-governing institution. The democracy’s method is not only the representative system and should combine the town meeting system. For the innovation of the residents sovereignty, the scale and tier of autonomy should design on the upward communication system.
