다원화되어 가는 현대사회에 있어서 새로운 치안수요에 대한 요구는 증가하는데 비하여 이러한 수요를 충분히 수용할 수 있는 공적 치안서비스의 자원에는 한계가 있다. 따라서 일정한 사적 영역에 있어서는 공권력의 공백에 따른 피해구제의 대안으로서 사적 치안서비스의 수요를 충족할 수 있는 새로운 제도로서 민간조사제도 도입의 필요성이 제기되고 있는 것이 현실이다. 즉 민간조사제도는 현대국가의 특성상 법치주의 국가로서 공권력이 할 수 있는 업무의 일정한 한계영역에 있어서 치안의 사각지대를 보완하고 국민의 권리보호에 기여할 수 있는 제도라고 할 수 있다. 이와 같이 민간조사에 대한 수요가 존재하고 있고 일정 영역에서 민간조사 형태의 업무가 이미 행해지고 있음에도 불구하고, 입법적인 토대를 갖추지 못한 상태에서 일반 서비스영역으로 접근함으로써 기업 및 개인정보유출, 사생활 침해 등 불법적인 조사활동에 따른 법적․제도적 흠결이 발생하고 있다. 민간조사업무는 본질적 특성상 타인의 기본적 권리를 침해할 우려가 있기 때문에 일정 수준 이상의 공공성과 도덕성이 요구되는 직역이라 할 것이다. 따라서 민간조사업이 우리사회에서 요구되는 필요영역을 담당함에 있어서 그 건전성을 유지하도록 하기 위해서는 법률에 명확한 근거를 두고, 업무의 내용적․절차적 한계를 명시함으로서 민간조사업의 법적 성격을 명확히 함과 아울러, 해당 업종 종사자들에 대한 일정수준의 자격요건과 관리감독기관에 의한 규제의 범위와 내용을 제시함으로써 조사원들의 윤리성과 준법성을 담보할 수 있도록 해야 할 것이다. 사적 치안서비스업으로서 민간조사업이 우리 사회에 올바르게 정착하기 위해서는 민간조사제도 도입으로 인한 일반국민의 기본권 침해에 대한 우려를 최소화할 수 있는 명확한 법적 규제의 틀 안에서 조사업무가 행해질 수 있도록 국가가 그 책임을 다해야 할 것이다.
In modern society becoming more diverse, there is a growing demand for new policing services, however, lack of resources has hindered pubic policing services from meeting the demand. some insist that it is needed to introduce private investigation system as an alternative to damage relief in certain private sphere where public policing services are not provided so that demand for private policing service could be met. In other words, the private investigation system could complement the blind spot of public policing services and contribute to the protection of the people 's rights in certain areas where the governmental authority, as a state of rule of law, has limitations to provide proper policing in the nature of the modern nation. It is true that there is certain demand for private investigation and a form of private investigation is carried out in specific area. As currently private investigation, without appropriate legislation, is conducted, there are legal and institutional defects caused by private investigation activities such as leakage of personal information, violation of privacy and so on. To ensure that private investigation should be carried out in accordance with its original purpose in society and maintain its soundness, it is required to establish relevant legislation clarifying the scope and legal nature of the service as well as providing the internal and procedural limits of it. In addition, it is needed to ensure that private investigators as well as those involved in private investigation services comply with the ethics and related laws by determining the scope and the specifics of regulation by supervisory authorities as well as qualification requirements for them.
