사회가 발전하게 되면 문화에 대한 관심이 증가하게 되고 자연스럽게 문화에 대한 소비가 확대된다. 현대 사회에서 문화가 가지는 의미는 매우 중요하다. 문화는 국가의 자긍심을 고취시킬 뿐만 아니라 경제적 발전과도 연관되어 있기 때문이다. 우리나라는 한류를 통해서 문화의 영향력을 이미 경험한 바 있다. 이제는 미술분야에서도 미술진흥을 위해 노력을 해야 할 시기이다. 이에 정부에서도 미술진흥을 위한 중장기 계획을 마련하여 착실하게 진행하여 오고 있다. 그중에서도 미술분야의 진흥을 위한 가장 기초적인 해결방안은 실력 있는 작가들을 발굴하고 역량을 강화시키는데 있다. 이를 위해서는 전속작가제도를 활성화시키는 것이 제일 좋은 해결방안이 된다. 이에 현대에 전속작가계약의 패러다임을 확인하기 위해서 후원의 개념을 검토하였고, 결과 전속작가계약의 현대 패러다임은 전위적인 미술작품이 지속적으로 창작될 수 있도록 하는 것이라는 점을 확인할 수 있었다. 또한 전속작가계약의 변천에 대하여 살펴본 결과 전속작가계약의 현대 패러다임은 미술작가의 창작활동을 ‘근로’로 인정하여 그들의 경제적 지위를 안정적으로 확보하여 생존권을 보장하도록 하여야 한다는 것을 확인하였다. 이러한 패러다임에 부합할 수 있도록 전속작가계약의 법적 성질을 분석하였다. 전속작가계약은 도급계약과 위임계약의 성질을 가지는 비전형 혼합계약의 성질을 가지고 있었다. 이에 각 성질에 따라 전속작가의 권리가 보호될 수 있도록 법리를 해석하였다. 본 연구의 결과는 전속작가제도를 시행하는 정부의 정책이 올바른 방향으로 나아가는데 일조할 것이라고 기대한다.
As the society is advanced, interest in the culture is increased and consumptions on the culture are expanded, accordingly. The meaning of the culture in the modern society is very important. Culture inspires the pride of the nation and is related to the economic progression. Korea has experienced the influences of the culture by the Korean wave. Now, it is the time to make an effort to promote arts in the art field. Hence, the government has prepared the mid-to-long term plans for art promotion and implemented step-by-step. Among these, the most fundamental solutions to promote arts are to develop talented artists and strengthen their competencies. To do so, the best solution is to active the system of exclusive artists. Sponsorship concept was reviewed to check the paradigms of exclusive artists contracts to date. It was found that the modern paradigm of exclusive artists contracts was to make Avant-artworks be created, continuously. Also, upon review on the changes of exclusive artists contracts, the modern paradigm of exclusive artists contracts showed to recognize the creative activities of the artists securing their economic status and natural rights. To meet these paradigms, legal characteristics of exclusive artists contracts were analyzed. Exclusive artists contracts have the mixed characteristics of vision type contracts consisting of service contract and delegation contract. Legal principles were interpreted to protect the rights of exclusive artists by each characteristic. The results of this study are anticipated to contribute the advancement of the governmental policies to perform the system of exclusive artists.
