복지정책에 있어서 사회 정의의 실현과 새로운 재분배 시스템을 어떻게 설계할 것인가와 관련하여 다양한 차원에서의 논의가 있어 왔으며 이는 앞으로도 쉽게 해결되지 않을 사안이다. 하이에크의 견해에 따르면 이 경우에 사회 정의를 실현하고 재분배 정책을 실시해야 하는 문제는 발생하지 않는다. 왜냐하면 하이에크에게 있어서 정의는 인간행동과 관련해서 문제되는 영역으로 인식되기 때문이다. 인간의 상호작용의 결과로 형성되고 자생적 질서에 의해 운영되는 시장에서는 결과적으로 분배와 관련한 문제가 발생하였다 하더라도 분배를 행한 실체가 없으므로 사회 정의와 관련된 문제는 발생하지 않는다. 현대적 소득의 재분배 모습은 요부조자에 대한 금원의 직접적 지급을 통하여 이전이 이루어지는 형태가 아니라 보건 및 의료서비스의 제공과 같은 분야에 공적부조를 활용할 수 있도록 하는 방식으로 이루어지는 것이 일반적이다. 공공서비스를 통하여 필요로 하는 욕구를 해결하는 형태가 발현되고 있으나 권리측면에서 보면 대상자에게 보장되는 기본권에 바탕을 두고 사회적 재화의 재분배가 발현되는 형태로 이해할 수 있다. 헌법의 이념인 개인의 자유와 창의를 최대한 존중하여 인류발전을 도모하면서 인류 공동체의 연대성에 대한 깊은 성찰을 통하여 인류 전체의 상생을 위한 복지제도의 구축과 소외계층의 접근 가능성 제고를 위한 공동체 구현에 초점을 맞추는 것이 타당하다.
There has been and will not be an easy solution to the social justice system in welfare policy and how to design a new redistribution system. Of course, there are some cases where direct cash payment is made, such as the basic income system, but the form of use through the provision of public services is more common. This can be understood as a modern redistribution based on fundamental rights, although in reality it appears to take advantage of the services provided. It is reasonable to focus on the establishment of a welfare system for the coexistence of the entire human community and the realization of a community for the better accessibility of the underprivileged through deep consideration of the solidarity of the human community, while promoting human development by respecting the ideology of individual freedom and creativity as much as much as possible.
