소방공무원은 화재 및 사고 현장 등에서 인명 등을 구조하고 재난에 대한 대비와 재난에 대한 피해구조를 위하여 다양한 활동을 펼치는 등 재난 현장의 최 일선에서 위험을 무릅쓰고 업무에 종사하고 있다. 그러나 현행 법률인 「소방기본법」은 소방에 관한 기본적인 사항과 소방작용에 대하여 규정하고 있으며, 소방에 관한 기본적인 작용에 관한 법률을 두고 있지 않다. 소방에 관한 작용법을 별도로 두지 않는 경우, 소방작용에 대한 명확성을 확보하기 곤란하므로 소방작용의 법적 근거를 명확히 하기 위하여는 일반적인 수권을 정하는 법률을 만들어 업무의 전문성과 법적 근거를 명확히 규정할 필요가 있다. 소방공무원이 화재진압을 위해 출동하는 상황에서 발생한 교통사고 등에 대하여 소방공무원에 대한 보상이 적절히 이루어지지 않고 있다. 또한 타인에게 발생시킨 피해에 대하여도 보상을 소방공무원 개인이 하는 등 피해구제에 대한 국가적 차원의 보상이 제대로 마련되지 않고 있어 소방공무원이 개인비용으로 이를 보상하는 경우가 발생하고 있다. 소방공무원이 화재, 사고, 재난 현장 등에 신속히 출동하여 그 재난 등으로부터 인명과 시설을 보호하기 위해서는 소방공무원의 법집행에 대한 구체적인 법적 권한과 함께 피해에 대한 보상책을 강구할 필요가 있다. 따라서 본 연구는 소방공무원이 화재현장 출동 시 등에서 발생하는 법집행의 문제점을 분석하고 이에 대한 개선방안을 제시하였다.

Firefighters take great risks of rescuing people from fire and on the science of accidents. In addition, they engage in preventing various disasters from occurring in advance so that they can reduce victims from calamities. However, the current law [Fundamental Law of Firefighting] only stipulates basic articles of firefighting and its operation. It means that the law does not cover fundamental operation of firefighting in detail so it is difficult to clarify the operation. Thus, it is necessary to establish a law regulating general authority, which is given to firefighters and their operation so that firefighters should get a legal ground for their works and professionalism. Besides, firefighters occasionally have a car accident on the way to sites. In that case, they do not usually get proper compensation for the accident from the government. To make it worse, fifefighters frequently make the compensation from their pockets for the damage and victims that take place during their operation. Hence, it is essential to handle with this problem. The government should compensate the damages and victims on behalf of firefighters on their duty. In order for firefighters to save people and protect facilities from catastrophes by swiftly arriving to sites, it is needed to build a law, which specifically states law enforcement of firefighters as well as to come up with a plan to compensate for the victims and damages that are caused by firefighters during their operation. Therefore, this study analyzes the problem of law enforcement concerning the authority of firefighters' operation and suggests its remedial measures.
