이 글은 문재인 정부가 ‘중앙권한의 획기적인 지방이양’의 전략적 방법론으로 채택한 ‘중앙권한의 기능 중심 포괄 이양’에 대하여 검토하고자 한다. ‘기능 중심 포괄 이양’은 이전 정부의 지방이양 방식의 한계를 극복하고자 나온 개념이다. 문재인 정부 이전에 추진해 온 지방이양은 지방의 실질적인 권한 확대가 아닌 단편적인 사무 이양에 치중하여 소위 ‘실질적 자치분권’을 실현하기에는 매우 미흡했다. 문재인 정부는 단위사무 중심의 단순 집행사무의 이양방식을 지양하고 기능 단위의 포괄적 이양방식을 지향함으로써 ‘실질적 자치분권’을 꾀하고 있다. 문재인 정부가 출범하고 자치분권을 위한 단계적인 제도개선 작업을 진행하고 있는 가운데 과연 그 작업들이 주민의 삶을 내실있게 변화시키고 개선하고 있는지에 대한 실질적인 자치분권을 고려해야 하는 때이다. 다음의 순서로 검토하고자 한다. 첫째, 지방자치제도와 자치권의 보장, 나아가 실질적 자치분권의 의미를 확인하고자 한다. 실질적인 자치분권의 개념은 우리나라의 지방자치제도의 역사에서 비롯되었다. 두 번째로 실질적 자치분권에 기여하는 기능중심의 권한이양에 대하여 개념, 필요성, 방법을 검토한다. 세 번째로 지방이양일괄법안에 대한 평가와 기능중심의 권한이양을 위한 공법의 역할과 과제를 탐색한다.
This paper examines the ‘functional decentralization of central authority’ adopted by the Moon Jae-in government as a strategic methodology of land transfer of central authority. ‘Function-based comprehensive transfer’ is a concept that came to overcome the limitation of the previous government's local transfer method. The local transfer, which was promoted prior to the Moon Jae-in government, was not very effective in realizing so-called “self-government” decentralization. Moon Jae-in is attempting to achieve “substantial self-government” by abandoning the method of transferring simple executive affairs centered on unit office and aiming at a comprehensive transfer method of functional units. It is time to consider the practical autonomous decentralization of the work of the Moon Jae-in government and the progress of system improvement for self-government decentralization. This paper describes in the following order. First, we want to confirm the meaning of local autonomy and autonomy, and furthermore, the meaning of real self - government. The concept of substantive autonomy decentralization comes from the history of the local autonomy system in Korea. Second, the concept, necessity, and method of function-based transfer of power that contributes to substantial self-government decentralization are examined. Third, we explore the roles and tasks of public law for evaluating and transferring the functions of the local transfer law.
