헌법 제21조 제3항은 방송의 기능이 적정하게 실현될 수 있도록 방송에 관한 제도를 형성할 것을 입법자에게 명하고 있는 조항이다. 위 조항에 따라 입법자는 방송제도의 형성에 관한 권한을 가지지만, 방송의 기능을 제대로 보장할 수 있도록 입법하여야 한다는 헌법적 한계도 부담한다. 공영방송은 방송의 기능 보장을 위해 입법자가 형성한 구체적 제도의 하나로서, 공적 주체에 의해 설립되고 공적 재원으로 운영되는 방송이다. 공영방송은 공적 주체에 의해 설립되고 공적 재원으로 운영되므로 기본권 수범자 지위를 갖지만, 동시에 국가와는 구별되는 독립된 존재로서 언론기관의 기능을 수행한다는 점에서 기본권의 주체로도 인정된다. 이러한 의미에서 공영방송은 이중적 지위를 갖는다. 공영방송은 언론의 다양성을 확보함으로써 민주주의 실현에 기여하고, 방송이라는 매체를 통해 인간다운 생활에 필요한 정보를 수집할 기회를 국민 모두에게 제공한다는 점에서 사회국가원리 실현에 기여하며, 공정하고 객관적인 정보의 제공을 통해 국민의 알권리를 실현하고 방송매체에 대한 접근 및 이용권의 실현에도 기여한다. 이와 같은 공영방송의 지위와 기능에 비추어 볼 때, 공영방송은 국가권력으로부터는 물론이고 특정한 사회세력으로부터 독립성을 유지하여야 하는바, 입법자는 공영방송의 조직구성과 재원조달에 있어서도 공영방송의 독립성이 관철될 수 있도록 제도를 형성하여야 한다.
Article 21(3) of the Korean Constitution provides the legislator with the right to form a broadcasting system so that the function of the broadcasting can be properly realized. In accordance with the provisions above, the legislative has the authority to form a broadcasting system, but it also bear the constitutional limit to ensure the proper functioning of broadcasting. Public broadcasting is established and operated by “public entity” through “public fund.” With regard to constitutional rights, public broadcasting has dual status. It is the holder and the observer of constitutional rights at the same time. The public broadcasting has three functions for realization of constitution. The first is to contribute to democracy by securing diversity of media. The second is the realization of social state principle by providing the public with the opportunity to gather information which is necessary for human life through the medium of broadcasting. The last is to guarantee the right to know by providing fair and objective information and the right to access to broadcasting media. In light of the status and functions of such public broadcasting, The legislative should make system under which public broadcasting can maintain its independence from specific social forces as well as from state power. The system also can assure independence of public broadcasting in the organization and financing.
