지방자치단체가 지방공기업을 설립하는 경우, 지방공기업법 및 동법 시행령에 근거하여 전문기관의 타당성검토를 진행하여야 한다. 행정안전부의 지방공기업 설립･운영기준에서는 타당성검토 관련 기준을 제시하고 있다. 현행 기준에서는 타당성검토에 포함되어야 할 조사항목 및 착안사항을 체계적으로 정리하고 있지만 검토항목의 중복, 지방공기업 유형별 특성의 부족 등의 문제점 역시 지적되고 있다. 또 일반적으로 타당성검토는 개별사업 추진 여부의 의사결정을 위해 활용되고 있기 때문에 설립 타당성검토의 목적이 명확히 정의되고 있지 않다. 이에 따라 본 연구에서는 지방공기업 설립 타당성검토 제도와 관련 현황을 분석하여 현행 제도의 문제점과 한계점을 파악하고, 이에 대한 개선방안을 제안하고자 한다. 구체적으로 본 연구에서는 지방공기업의 경영이념, 타당성검토의 목적 등을 고려하여 설립 타당성검토의 목적을 보다 명확히 정의한다. 뿐만 아니라 대상사업 및 지방공기업의 유형별 특성을 반영하는 등 현행 ‘지방공기업 설립･운영기준’에서 제시하는 검토항목의 재정립 및 수정보완 사항을 제안하여 설립 타당성검토의 수용가능성을 제고하고, 지방공기업의 유형별 특성의 반영을 통해 실효성을 제고하고자 한다.
Local governments could establish local public enterprises to achieve their goals efficiently. As of December 2017, 399 local public corporations nationwide were established to help local governments perform their business efficiently. For local governments to establish local public enterprises, they should consider the feasibility of the establishment in advance based on ‘Local Public Enterprise Act’. In addition, the 'Local Public Enterprise Establishment·Operation Standards' by ‘Ministry of Public Administration and Security’ provides the review items that should be included in the feasibility study. However, it is also pointed out that the current standards lack a reflection of the characteristics of each type of local public corporation. In addition, the purpose of the establishing feasibility study is not clearly defined because the feasibility study is generally used to make decisions on whether to run individual projects. The purpose of this study is to enhance the effectiveness and expertise of the establishing feasibility study. To achieve this purpose, firstly we identify the problems and limitations through previous studies and case analysis, and we defined the purpose of establishing feasibility study by considering the management philosophy of the local public enterprises. Moreover, we propose the improvement criteria for feasibility study that reflect the characteristics of each type of local public enterprises.
