외국의 사례와 현재 우리나라에서 경찰의 물리력 사용의 기준이 되고 있는 근거법령과 판례를 종합하여 비교 검토하면 영국, 미국, 일본과는 달리 한국에서 경찰관들의 물리력 사용이 더 엄격하게 제한되고 있다. 경찰관들의 주관적 판단이나 합리적 실수를 인정하지 않고 객관적 종합적 상황을 판단하여 물리력을 사용할 것을 현장 경찰관들에게 요구하고 있는 것이다. 그러나 영국, 미국, 일본 등과 비교하여 볼 때, 경찰관직무집행법, 위해성 경찰장비의 사용기준 등에 관한 규정 등 관련 법령이 명확하게 경찰관들에게 물리력 사용의 기준을 제시하지 못하고 있는 것이 현실이며 이러한 문제에 대한 개선대책으로 저항 수준에 따른 물리력 사용의 종류와 한계에 대한 매뉴얼을 제작하여 경찰관들에게 명확한 사용 기준을 제시하고 교육훈련에 활용함으로써 경찰의 현장 대응역량을 강화할 필요가 있다. 물리력 사용기준에 대한 법형식은 매뉴얼, 훈령, 위임규정 있는 훈령, 대통령령 등 다양한 방식이 있으나 상황별 세부사항에 대한 대응요령을 제시할 필요가 있다는 점을 고려하면 훈령이나 대통령령보다는 매뉴얼 형식으로 사용기준을 구체화하는 것이 타당할 것이며, 영국과 미국에서도 법령과 구분하여 가이드라인 형식으로 규정화하여 활용하고 있다.
A use of force continuum is an example that provides law enforcement officers and civilians with guidelines as to how much force may be used against a resisting subject in a given situation. This study aims to explore various standards of police forces in different jurisdictions. It is general to use a model of escalation of force. The purpose of such a model is to clarify the complex subject of use of force both for police officers and civilians. The standards of use of police force are central parts of law enforcement agencies' use of force policies. In England and Wales, U.S.A, and Japan, various criminal justice agencies have developed different standards and there is no universal or standard model. In general, each different agency has its own use of force policy and standards which are provided in detail. However, in South Korea, there is no precise regulations of use of police force. Police officers in general hesitate to use forces since they do not know whether they can use specific forces such as electronic control devices and weapons. Citizens cannot expect categories of force which will be employed by the police under specific circumstances. It is necessary for the Korean Police Agency to create a model of escalation of force for both police officers and citizens. The use of force continuum helps to clarify the complexity of use of police force. This enables both the police and citizens to anticipate how much force may be used in a given circumstance. As a consequence, the model may decrease unnecessary conflict between the police and citizens and should increase efficiency in policing overall.
