우리 사회의 커다란 이슈인 아동･청소년의 성매매는 지속적으로 증가하고 있으나 아동･청소년 성매매 정책은 이들에 대한 특성이 반영되지 못한 채 처벌과 보호지원이라는 이원공조정책시스템을 유지하고 있다. 「현행 아동･청소년의 성보호에 관한 법률」상 대상아동･청소년 성매매는 피해아동･청소년의 성매매자와는 달리 취급을 하고 있는데 이들의 실태와 인권침해현황을 살펴보고 이에 대한 문제점을 알아본다. 즉 아동･청소년의 가출경험 등 현황, 성매매현황, 성매매시 인권침해 실태, 성매매 수사 및 재판과정에서의 인권침해 실태 등을 알아보고 이에대한 개선책을 제시한다. 우선 아동･청소년 성매매를 성착취로 규명하고 현행법상 대상아동･ 청소년 개념을 삭제하고 피해아동･청소년으로 법적 보호지원이 이루어져야 하며, 성매매 범죄의 철저한 규제와 엄중한 처벌을 가해야 할 것이다. 둘째, 아동･청소년 성매매를 담당하는 전문기관 설치가 요구되며, 셋째, 아동･청소년의 성매매 유입방지 및 차단을 위한 시스템을 구축하여 사이버 성매매 방지를 위한 다각적인 대응방안이 마련되어야 할 것이다.

First of all, the government should identify child and juveniles sex traffic as sexual exploitation, eliminate the concept of children and juveniles involved under the current law, provide legal protection as victimized children and juveniles involved and thoroughly crack down on sexual exploitation crimes and stern punishment. Second, a specialized agency in charge of child and juveniles sex trade is required to be installed and, third, diverse measures should be taken to prevent online prostitution by establishing a system to prevent the inflow of child and juveniles sexual exploitation
