본 연구는 우리나라 국회와 지방의회에서 시행 중인 인사청문회의 도입과정과 실태, 그리고 실제 운영절차와 방법에 대해 비교 분석한 후, 지방의 인사청문제도 개선방안과 정책적 시사점을 제시했다. 개선방안으로는 첫째, 지방 인사청문회의 법적 근거를 마련하거나 지방자치단체에 자율성을 부여할 필요가 있다. 둘째, 본회의 의결을 거쳐 인사청문특별위원회를 구성하고, 개인정보 제공, 회의 공개, 인사청문 실시 등에 대한 후보자의 동의서를 제출받아 법적 분쟁을 사전에 방지할 필요가 있다. 셋째, 의회예규나 협약에서 다루지 못한 세부 사항은 다른 조례와 규칙 등을 준용토록 함으로써 논란과 갈등을 방지하고, 인사청문 과정을 공개해 주민의 알 권리를 강화해야 한다. 넷째, 지방의회가 인사청문 경과보고서에 후보자의 적격 여부를 명시하도록 하고, 청문회 기간을 현행보다 확대할 필요가 있다. 정책적 시사점으로는 첫째, 지방의회 인사청문회는 단체장과 지방의회 간 협치의 산물로서 내부 정책결정자가상호 협의를 통해 새로운 제도를 도입한 사례이다. 둘째, 최근 서울 관악구가 기초의회 중 처음으로 인사청문제도를 도입한 점을 봤을 때, 수직적･하향적 확산이 진행되고 있다. 셋째, 지방의회 인사청문회도입의 찬･반 논란에도 불구하고 인사 검증과정에서 후보자가 낙마하거나 부적격 사유로 자진사퇴한경우가 발생하는 등 인사검증절차로 자리매김해 가고 있다.
This study compares and analyzes the introduction process, the actual condition, the operation procedure and the method of the confirmation hearing in the Korean National Assembly and the Local Council. And it suggested improvement measures and policy implications for the local council’s confirmation hearing System. As an improvement plan, First, it is necessary to establish legal basis for the local council’s confirmation hearing or to give autonomy to the local government. Second, it is necessary to form a special committee on confirmation hearing through the resolution of the plenary session, and to submit the consent of the candidates for the provision of personal information, the disclosure of the meeting, and the execution of the confirmation hearing. Third, details that are not covered by council’s statutes and conventions should be prevent controversy and conflict by using other ordinances and rules. The confirmation hearing process should be open to public to strengthen the citizen’s right to know. Fourth, it is necessary for the local council to specify the candidate’s qualifications in the progress report of the confirmation hearing and extend the duration of the that hearing. The policy implications are as follows: First, the local council’s confirmation hearing is the result of the cooperation between the head of the local government and the local councils, and the policy makers of both organizations introduced the new system through mutual consultation. Second, the fact that the Gwanak-gu Council recently introduced the confirmation hearing System for the first time in the District Local Council is evidence that the confirmation hearing is spreading vertically and downwardly. Third, despite the controversy over the introduction of the system, it is true that the confirmation hearings have become an effective system for the candidate’s verification, with the candidate fails or voluntarily resigns during the verification process.
