성폭력사건에 대해서는 21세기에 접어들면서 자극적인 언론보도와 그에 따른 사회적 공분에 의한 재범방지책의 요구에 의하여 새로운 제도들이 도입되게 되었다. 2000년 신상공개제도가 도입되었고, 2007년 전자장치부착에 의한 전자감시제도가 도입되었다. 특히 아동 대상 성폭력범에 대한 가장 강력한 재범방지 제도가 바로 화학적 거세인 바, 우리나라에서도 2011년 도입되었다. 성충동 약물치료제도가 도입된 이후에도 위헌논쟁이 계속되었고, 마침내 2015년 헌법재판소에서 성충동 약물치료제도에 대한 원칙적 합헌결정이 내려져 위헌논쟁은 일단락되었다. 그러나 그 이후에도 성충동 약물치료제도에 대한 폐지론 및 개선안에 대한 논의가 계속되고 있다. 시행현황을 보면 제도 도입 이후 6년간의 성충동 약물치료명령은 합계 36건이며 1년간 평균 6건 정도에 불과하다. 이러한 약물치료명령 건수는 당초 예상보다는 너무나 적다 할 것이므로, 부작용에 대한 염려나 개선책의 보완보다는 우선적으로 검찰의 적극적 재범의 가능성의 해석을 통한 약물치료명령의 청구건수와 집행건수가 확대되어야 할 것이다. 논란 끝에 시작된 성충동 약물치료제도가 성폭력범죄의 재범방지라는 본연의 목적을 달성하기 위해서는 우선적으로 제도의 정착이 필요한 상황으로 보인다.
As for the cases of sexual violence in the 21st century, new systems have been introduced by the demands of stimulating press media reports and social co-ordination preventive measures. In 2000, the Disclosure System of Personal Information of Sexual Offenders was introduced, and in 2007, an Electronic Monitoring System with Electronic Devices was introduced. In particular, Chemical Castration is the most powerful anti-recidivism system for child sex offenders, and it was introduced in Korea in 2011 as well. Even after the introduction of the Drug Treatment System, the Constitutional debate continued, and in 2015 the Constitutional Court finally decided on the principle of constitutional amendment of the Drug Treatment System, and the Constitutional debate was over. However, discussions on the abolition and improvement of the Drug Treatment System are continuing. As for the implementation status, the total number of Drug Treatment orders for the six years since the introduction of the system is 36 cases, and the average is only 6 cases per year. The number of Drug Treatment orders will be much smaller than originally expected. Therefore, the number of Drug Treatment orders and the number of executions should be expanded through the interpretation of the possibility of the recidivism of the public prosecutors, rather than compensating for concerns or side effects. The Drug Treatment System, which was started after the controversy, seems to be a situation that needs to be settled first to achieve the purpose of preventing the recidivism of sexual violence crime.
