부산형제복지원사건·광주인화원복지시설사건 등을 통해 사회복지시설 운영과정에서 많은 복지시설이용자에게 육체 또는 정신적으로 큰 피해를 발생하면서 개인의 기본적 인권이 무분별하게 침해되었음이 밝혀졌다. 이처럼 사회복지시설에서의 심각하게 인권침해사건은 사회복지이용자에게 보장된 헌법 최고의 가치인 인간존엄성, 자유·권리 등 헌법의 핵심가치를 침해하는 중대한 인권침해 문제이다. 그리고 다양한 사회복지시설제도 운영과정에서 발생한 기본적 인권의 침해유형·침해정도·침해기간 등과 관련해 성추행·성폭행 등 여러 유형의 인권침해사건이발생해왔다. 또한, 사회복지시설 운영과정의 인권침해가 장기적·반복적으로 지속된 경우도 있다. 더욱이 사회복지시설 감독기관이 있었음에도 불구하고 노동착취·감금 등 행동의 자유 억압은 물론 신체 훼손과 생명까지 침해된 사례도 있다. 아울러 사회복지를 필요로 하는 사람에게 헌법의 최고가치인 인간존엄성을 구현하는 동시에 국민이 인간다운 생활을 할 수 있도록 보장하기 위해 마련·운영된사회복지시설제도가 오히려 최소한의 삶을 보장하지 못할 뿐만 아니라 심지어 국민의 생명과 자유에 원상회복이 용이하지 않을 정도의 심각한 침해를 발생시켰다는 점에서 사회복지서설제도에 대한 운영부실논란 등의 우려와 비판이 급증했다. 특히 사회복지시설제도 운영과정에서 나타난 심각한 기본적 인권침해 문제를방지·근절시키는 것은 물론 인간존엄성 구현, 사회국가원리 실현, 사회적 기본권보장, 국민에게 인간다운 최소한의 삶 보장 등의 헌법상 이념·기본원리·기본권을구현하기 위하여 마련된 사회복지시설제도가 원래의 입법취지에 부합하게 운영되도록 함으로써 지역사회복지체계를 구축하고 사회복지 증진에 이바지해야 한다. 이러한 상황에서 전국적으로 운영되고 있는 다양하고 많은 사회복지시설제도가 헌법상의 인간존엄성 등의 이념과 기본권존중원칙 등은 물론 사회복지시설제도를 도입할 당시의 취지에 적합하게 운영되고 있는지 그 실태와 여러 문제점들을 함께 분석하는 동시에 다양한 사회복지시설의 수많은 이용자에게 헌법이 보장한 헌법가치인 인간존엄성과 기본적 인권이 무분별하게 침해되지 않도록 방지·근절을 위한 사회복지시설제도의 개선방향을 분석·검토해야할 필요성이 크다. 그러므로 본 연구에서는 다양한 분야에서 운영되는 사회복지시설제도운가 폭발적으로 증가하고 있는 헌법현실의 변화 속에서 우리 헌법이 그 보호·보장을 천명한 인간의 존엄성, 사회국가원리, 사회적 기본권 등의 헌법적 가치가 실질적으로 보호·보장될 수 있도록 하기 위하여 사회복지시설제도의 헌법적 의미, 기본권침해의 실태, 헌법적 보장 등 분석하고 이를 토대로 사회복지시설이라는 법제도적 장치의 운영과정에서 나타난 인간존엄성과 기본권의 심각한 침해를 방지·예방및 근절을 위한 합리적인 개선방향의 원칙·고려사항·세부내용 등을 검토하겠다.
