조선 개창 당시 승은 사회적으로 지나치게 증가한 상태였다. 고려시기 치성했던 불교의 여파로 조선초 『조선왕조실록』에서 승의 수가 민의 3할에 이른다고 기록할 지경이었다. 이미 고려말부터 지적되어온 무분별한 출가와 승도 과잉 현상은 이 시기 조정이 직면한 심각한 사회문제였던 것이다. 이 승도 과잉 현상을 통제하기 위해 고려말부터 도승의 법을 강화하여 운영하였다. 도승이란, 나라에서 정한 절차에 따라 승을 출가시킨다는 의미의 제도적 용어이다. 도승을 통해 출가한 승은 제도적으로 출세간임을 인정받는 것이다. 따라서 국역에서 공식적으로 면제되는 특전을 부여받았다. 조선은 개창 직후부터 시작한 법전 편찬 작업에 도승과 관련한 사항을 여럿 포함시켰다. 조선의 첫 공식법전인 『경제육전』에서는 도승의 항목에서 도첩을 줄 때의 조건을 명시하고 있다. 조선의 도승법은 승에 대한 법임에도 세속 신분에 대한 강력한 제한을 두고 있는 것으로 보여 주목된다. 도승은 ‘양반 자제’라는 높은 신분에 한정되었으며, 승을 지배층으로 간주하는 이러한 시각은 고려적 전통의 연장선에 있는 것이었다.
Due to the influence of Buddhism, which had prevailed until the Goryeo Dynasty, the number of Buddhist monks in early Joseon was increased so excessively that they were estimated to be nearly 3/10 of the people. The prevailing social trend of leaving home and the resulting excessive number of monks that had already been the concerns of the government from late Goryeo became serious social problems facing the government of this period. In order to regulate this excessive number of monks, the doseung(度僧) law was strengthened from the end of Goryeo. Doseung is an institutional term which means ‘becoming a monk following the procedures set by the government’. Buddhist monks qualified by receiving dochup(度牒) under legal procedures of doseung were given the prestigious right to be excluded from the forced labor; Buddhist monks without dochup were not to be exempted from the statute labor and could be forced to return to secular life. Gyongjeyukjeon(經濟六典), established shortly after the birth of Joseon, included the doseung and other related measures. Doseung of this Code was characterized by strong restrictions on the candidate status to be a monk. The aim of doseung was to restrict the increase of legal monks by permitting those who were secularly in high status exclusively to be a monk. In this respect, Gyongjeyukjeon, which issued doseung only to such a high status as yangban(兩班) and regarded Buddhist monks as a ruling class, still maintained the tradition of Goryeo.
