양성평등과 관련한 헌법 개정의 목적은 양성평등의 실현 을 통하여 지속가능한 공동체 로서 대한민국을 발전시키는 것이어야 한다. 따라서 양성평등의 실현은 궁극적으로 현재 및 미래의 대한국민의 안전, 자유와 행복의 수준을 향상하는 데 기여하여야 한다. 양성평등은 단순한 차별금지 이상으로 동등한 참여·대우 보장을 의미하므로, 이른바 형식적 평등 아닌 실질적 평등 을 핵심내용으로 한다. 그래서 양성평등의 구체적 내용은차별금지를 넘어서 양성 상호간의 존중과 동등한 대우를 지향하되, 이를 각 영역에 따라다양한 형태로 구현되어야 한다. 따라서 양성평등에 관한 일반적 원리를 선언하는 규정과 이를 특별하게 구체화하는 규정을 별도로 마련하는 것이 바람직하다. 양성공동체로 이뤄지는 가정·직장·국가에서 당분간(잠정적으로) 여성에 대해서는 특별한 배려를, 남성에 대해서는 균등한 역할을 각각 부여할 필요가 있다. 특히 여성에게 유리한 차별허용 규정과 유리한 차별명령 규정을 적절히마련하는 것이 중요한다. 이와 관련하여 여성 근로의 특별보호 규정을 유지하고, 여성 복지및 권익 향상의 규정을 삭제하는 것이 바람직하다. 헌법상 혼인 및 가족제도의 가치를 생각할 때 혼인은 남자와 여자의 결합으로 규정하는 것이 바람직하다.
The purpose of revising some constitutional clauses regarding to the equality of sexes must be to develop the Republic of Korea as a "sustainable society" through "the realization of de facto equality between women and men". The realization of the equality, therefore, must contribute ultimately to improving the level of public safety, freedom and happiness for the present and the future Koreans. The equality between women and men means an equal participation and treatment in all sphere of public and private life, more than just discrimination prohibition. It essentially pursues not formal equality but effective equality in various forms in each area. Therefore it is desirable to separately provide the provision declaring the general principle on the equality of sexes and many provisions that specifically embody it. The affirmative action that temporarily gives special consideration to women is required at the communities such as homes, workplaces and the public sectors. In particular, it is important to adequately provide provisions that allow the advantageous discrimination to women, and that further demand it under specific conditions. In relation to this, it is desirable to maintain the provision of special protection for female labor(§32④) and delete the provision for women's welfare and interests(§34③). When considering the constitutional value of marriage and family system, marriage must be defined by a combination of male and female.
