부동산경매시장에서 유치권의 문제는 이미 많은 선행연구에서 제기되었으며, 비록 회기만료로 폐기되었으나 법무부도 입법예고에 이르렀던 것으로 볼 때, 정부나 학계를 막론하고 현행 규정이 더 이상 현실을 설명하지 못하고 있다는 점에 대하여 대체적으로 공감대가 형성된 것으로 보인다. 이렇게 입법적 해결이 지연되고 있는 가운데 현실의 문제가 지속되자, 판례는 해석으로서 민사유치권과 상사유치권을 구분하고 사실상 부동산경매시장에서 상사유치권을 인정하지 않기에 이르렀다. 그러나 이러한 상사유치권에 대한 판례의 태도는 실체적 진실의 발견이라는 측면에서 볼 때에는 일응 타당한 측면이 있는 것은 사실이나, 조문의 한계를 넘는 해석으로서 더 이상 ‘법안의 발견’이 아닌 ‘새로운 입법’을 초래한 것은 아닌지 의심스럽다. 이러한 연구의 필요성에 의하여 검토한 결과, 일단 현행 규정은 현실의 문제를 해결하기에 한계가 있으므로 입법적 해결이 불가피한 것으로 판단된다. 구체적인 입법방향은 우선 상법 개정을 통해 상사유치권의 인정대상을 ‘채무자 소유의 물건 또는 유가증권’에서 ‘채무자 소유의 동산’으로 한정하고, 부동산 상사유치권자들에게 저당권설정등기청구권을 부여하면서 동시에 민사집행법개정을 통해 유치권도 소멸주의에 따르도록 하는 방식이 타당해 보인다. 앞으로 이러한 연구가 지속된다면 상사유치권 제도가 좀 더 현실을 잘 반영하는 제도로 성장하는데 도움이 될 것이다.
In the real estate auction market, the issue of lien has already been raised in many studies. Even though it has been abandoned due to the expiration of the session, it seems that the Ministry of Justice is fully aware of real issues so that they make pre-announcement of legislation. However, the problem persists as the legislative solution is delayed. Under this circumstance, the precedent interpretation has separated civil lien from commercial lien and eventually has denied commercial lien in the real estate auction market. The subsequent precedent attitude seems to be confirmed. The consideration of this precedent for commercial lien has a reasonable aspect, but academia has constantly criticized that interpretation of the law should be the discovery of a bill, not bringing about new legislation. In short, it is clear that there is a real problem in the current regulatory system, so it seems that a legislative solution is inevitable in the end. As a result of reviewing the necessity of such research, it seems reasonable to adopt the way of empowering ‘the right to demand creation of mortgage’ while following an extinction principle seems reasonable and limiting the target of commercial lien to ‘movable assets’, If such a study continues in the future, the system of commercial lien will grow into one that reflects more reality.
