본 연구의 목적은 북한의 ‘라선경제무역지대 외국투자기업로동규정’과 ‘경제개발구 로동규정’을 비교 분석하여 북한 경제특구 복지법제의 동향을 추적하는 것이다. 분석대상은 북한이 2013년 각각 제정한 ‘라선경제무역지대 외국투자기업로동규정’과 ‘경제개발구 로동규정’이다. 이를 통해 본 연구는 양 법령의 지속성과 변화, 공통점과 차이점을 발견하였다. 연구방법은 문헌연구를 중심으로 하여 원 자료인 동 법령들을 놓고, 노동과 복지 관련 조항을 핵심 분석대상으로 하여 법제도 분석에 일반적으로 사용되는 방법인 질적 내용분석을 통해 분석하였다. 이에 본 연구는 양 규정을 놓고 ① 근로소득, ② 근로복지, ③ 사회보장을 중심으로 분석하였다. 분석결과, 지속성은 근로소득, 근로복지, 사회보장 부문 모두 공통적인 조항과 동일한 내용이 다수였다. 특히 세부 법 조항의 정의와 서술 내용이 거의 동일한 부문이 많았다. 이는 후에 제정한 「경제개발구 로동규정」이 먼저 제정된 「라선경제무역지대 외국투자기업로동규정」의 세부 조항을 그대로 인용한 사례로 반증된다. 그리고 이러한 원인은 ① 양 로동규정의 내재적 속성과 3개월이라는 시간적으로 짧은 입법 차이, ② 제정 시기를 기준으로 당시 북한의 가장 현대화된 법령이고, ③ 이로 인해 북한의 입장에서 별다른 법적 수정을 할 필요성이 뚜렷하지 않았기 때문이라 판단된다. 변화는 양 로동규정 만을 놓고 보면 뚜렷한 차이점이 나타나지 않는다. 이에 양 로동규정은 세부 법 조항의 공통점이 상당한 반면 확고한 차이점은 크지 않다. 이는 결국 먼저 제정한 「라선경제무역지대 외국투자기업로동규정」을 갖고 후에 제정한 「경제개발구 로동규정」이 이를 재차 인용한 행태에 기인한다.


The objective of this study is to compare and analyze ‘the labor regulations for foreign investment enterprises in Rasun Special Economic Trade Zone’ and ‘the labor regulations in Economic Development Zone’ and trace the dynamics of welfare legislation for the Special Economic Zone in North Korea. The object of this research for comparative analysis was ‘the labor regulations for foreign investment enterprises in Rasun Special Economic Trade Zone’ and ‘the labor regulations in Economic Development Zone’ which were established respectively in 2013 by North Korea. This study spotted the common features and the different ones between the two legislation through the process. The research methodology of this treatise was the qualitative content analysis, which is commonly used for the analysis of the legal system, centering on the relevant regulations of the labor and the welfare, by utilizing the above two regulations for the literature research. the analysis of this study was concentrated on ①labor income ②labor welfare ③social security by using the two regulations. The outcome of the analysis was that the durability was commonly represented through the common articles and content in all the three parts, which was not a few. Especially, the definitions of the detailed law provisions and described contents of the regulations considerably resembled each other, which demonstrates that the labor regulations for foreign investment enterprises in Rasun Special Economic Trade Zone parroted the detailed articles of the labor regulations in Economic Development Zone which had been previously established. And the causes were as follows: ①there were the inherent traits of the two labor regulations and the short legislating gap in time between them ②the two regulations were both the most modernized ones of that time in North Korea based on the establishing period ③accordingly, North Korea didn't feel the necessity for extra modifications on the regulations. The writer can't identify the distinct differences just between the two labor regulations. This means that the labor regulations for foreign investment enterprises in Rasun Special Economic Trade Zone, which was set up later, recited the labor regulations in Economic Development Zone which had been established beforehand. In conclusion, the two labor regulations have common features in detailed law provisions considerably, while definitely different ones are not to be found a lot. However, minute differences exist. For instance, specific time on the extended or night-time work, which fall under the labor income, was not stipulated in the 「the labor regulations for foreign investment enterprises in Rasun Special Economic Trade Zone」 which North Korea set up later. In the case of labor welfare, the worker's duty of good faith was added, extending employee hours was restricted to three hours per day, and there was no content on the period of maternity leave. In effect, the rest contents of the two labor regulations are almost the same saving for these. Especially, in the case of social welfare, there are no distinct differences and exists numerous common points only.
