수사절차에 있어서 전통적 특징으로 인정되어 온 수사의 밀행성·강제성·기동성·탄력성의 필요는 자칫 경찰수사가 인권보장을 경시하게 되는 빌미를 제공하는 계기가 되기도 하였다. 그러나 이제는 과거의 수사관행을 과감하게 타파하고 수사의 효율성을 제고하여 범인검거·처벌의 수사목적을 완벽하게 달성하면서 인권보장에도 소홀함이 없도록 경찰의 수사 활동이 인권의 수호자로서 첨병역할을 수행하는 주체가 되어야 할 것이다. 더 나아가 경찰이 인권보장의 역할을 충실히 할 때 경찰수사 활동의 효율성도 증대된다. 따라서 경찰수사의 전문성을 강화하고 수사의 공정성을 보장한 인권보장과 국민 중심의 수사가 전개되어야 할 것이다. 앞으로 경찰수사가 국민에게 전폭적인 신뢰를 얻기 위해서는 인권보장의 수사관행을 정착시키는 것 외에 전문성을 강화하는 것도 시급한 과제이다. 또한 경찰수사의 전문성 강화는 현재 논의되고 있는 검찰과의 수사권 조정을 통해 독자적인 수사권을 확보하기 위해서도 반드시 해결해야 할 당면과제이다. 경찰이 독자적 수사권의 형태를 갖추기 위해서는 모든 인지된 범죄에 대한 1차적 수사권을 경찰에 부여하여 경찰의 수사업무 효율성을 제고하고, 검사의 수사업무 부담을 경감시키도록 해야 한다. 또한 검사의 기소를 보다 공정하고 정확하게 하여 국민의 신속한 재판을 받을 권리를 보장하며 현행 경찰의 독자적 수사관행을 현실화시키도록 해야 할 것이다. 따라서 사건송치 전의 수사에 대해서 경찰과 검찰의 상호협력과 견제균형의 관계 유지는 능률적이고 공정한 범죄수사에 기여할 것이다. 현재 국회에서 논의되고 있는 조정안에서 수사는 경찰이 전담하고 검찰은 기소와 공소유지업무만 담당하는 것이 바람직하다고 할 수 있다. 이는 검사가 수사에 관여하지 않고 공소사무에 전념함으로써 예단을 배제하여 공소사무의 순수화를 도모, 재판의 적정을 기할 수 있고 중복수사의 폐해를 제거하여 수사의 능률을 향상시킴으로써 궁극적으로 국민편익을 증진시킬 수 있을 것이다. 따라서 수사의 독점 구조를 조정하여 상호협력 체제를 구축하고 상호 견제균형에 의하여 수사능력의 향상을 기하도록 하여야 한다. 결국 수사기관의 범죄수사에 있어서 실체적 진실발견 못지않게 중요한 것은 수사과정에서 적법절차를 준수하고 인권을 존중하는 것이다. 거기에 수사의 전문성이 요구됨은 물론이다. 인권을 존중하면서도 과학수사를 통해 실체적 진실을 밝히는 것은 경찰수사가 국민의 신뢰를 받기 위한 전제조건이다. 따라서 경찰이 합리적 사고와 과학적 수사방법 그리고 충분한 법률지식으로 무장된 전문수사관들을 양성, 확보하고 경찰수사의 전문성을 강화하여 전폭적인 국민의 신뢰를 받는 국민의 경찰로 자리매김할 수 있도록 인권존중의 경찰수사관행을 확립하고 수사역량을 강화하도록 하여야 한다.

In such circumstances, human rights often ignored. But from now on, police investigation should be changed. The investigation should seek its original purpose, catching and punishing perpetrators while it can ensure the human rights. When the police make efforts to protect human rights, the investigation will be more efficient. In addition, police investigation should be more professional and just and fair to ensure human rights and be helpful to people. In order that police gains confidence from people, the investigation should not only ensure human rights but also be more professional. Being more professional is also essential for the police to have independent authority of investigation. Now, the conflict with prosecutors in relation to investigation authority has not been resolved. For the police to have such independent authority, the primary investigation right shall be assigned to the police. If that is done, police will be more efficient and prosecutors also have fewer jobs to do. In addition, prosecutors should be more fair and accurate in prosecuting, so trials should proceed without delay and causing discomforts. And independent investigation must be realized in police investigation. Cooperation and balancing of jobs between police and prosecutors will contribute to fair and just investigation. Now, the parliament is discussing that police has the whole authority of investigation and prosecutors have the authority of prosecution and sustaining such prosecution. If that is done, prosecutors can avoid prejudices in cases and be more fair and just on the trials. Also they can avoid duplication in investigating cases, leading to more efficient investigation and being more helpful to people. Thus, cooperation and power balancing of two parties should be established to improve investigation. In criminal investigation, finding truth is important. And as important as it is complying with laws and protecting human rights. Of course, investigation should be professional. Respecting human rights and pursing scientific investigation are preconditions in that police gain confidence from people. In the future, police should be more rational and scientific in investigation, train professionals with law knowledge. And along with them, police should establish practices of respecting human rights and strengthen investigation capabilities. When doing so, police can be considered reliable by people.
